Dear Information Request,

I refer to the copy licences sent under cover of your earlier email.

I would like you to reconsider the position as regards the redactions you have made pursuant to s40. I do not believe that the name of the licence holder is personal data. A name may be considered personal data in some circumstances. However, licensing is by its very nature a public activity, it is a public record of permission granted to an individual or entity to carry out a particular activity. The need to identify the person or entity with permission to carry out the activity is intrinsic to making licensing operate in the public interest.

In addition I note that three out of the four licences provided do not detail the number of dogs kept for the regulated activity. It appears to me that this is not compliant with the current licensing regime. I refer to

3.0 Use, number and type of animals Condition
3.1 No animals or types of animal other than those animals and types of animal specified in the licence may be used in relation to the relevant licensable activity.
Guidance
• The licence conditions must clearly state the total numbers of dogs that are kept for the licensable activity permitted at the premises including puppies.

I do appreciate that the question of whether or not the licences are compliant is not an information issue. I am happy to take the matter up separately with the appropriate team/person. Perhaps you could discuss the issue with your colleague(s) responsible for licensing dog breeders and then revert to me. I am happy to deal with the redactions and compliance all at once, or as two separate issues.

I look forward to hearing from you.

Yours sincerely,

Martina
