Dear Charnwood Borough Council,

I am making a Freedom of Information request. Please provide the following information.

• Number of applications for a new licence in last 12 months
• Number of applications for a licence renewals in last 12 months
• Number of new licences granted as a result of an application made in the last 12 months
• Number of licences renewed as a result of an application made in the last 12 months
• If appropriate, grounds on which any licence (new or renewal) was refused.
• A copy of each dog breeding licence currently issued.
• Please confirm the number of staff and qualifications of staff employed by each licence holder (for the avoidance of doubt I am not requesting any details of individual staff, just number employed by each licence holder and the qualification(s) held)
• When applying for a new licence or a renewal which of the following do you require in respect of the animals specified in the licence
o Name
o Gender
o Age and/or date of birth
o Microchip number
o Breed
o Description
o Date of purchase
• Where a breeder buys/sells a breeding dog during the period of an issued licence do you require them to notify you of the change at the time of the sale/purchase of the dog or are records only updated at the time of the renewal application?
• What steps, if any, do you take to ensure that each breeder complies with The Microchipping of Dogs (England) 2015 regulations?
• Number of staff employed to conduct inspections during last 12 months
• Total number of inspections conducted during last 12 months
• Number of litters produced (and number of puppies in each litter) by each licence holder
• If you keep records of Kennel Club Assured Breeder Scheme members please confirm which licence holders are also members of this scheme
• Price charged for new licence
• Price charged for renewal of a licence
• Has any licence been revoked or suspended in the last 12 months? If so, please provide details of licence holder and reason for revocation or suspension
• Number of complaints received in the last 12 months and the name of the licence holder complained about. Where a complaint has resulted in enforcement action please confirm what enforcement action was taken and the name of the licence holder (or refer to answer above if details already provided in relation to revocation or suspension of licence)

The Freedom of Information Act (the Act) gives the public a right of
access to information held in recorded form by a public authority.  It
does not require authorities to create new information or find the answer
to a question from staff who may happen to know it.  The Council is also
required to consider any information released under the Act as if it were
being released to the world at large. 

 

The Council will provide the information requested wherever possible,
however the Act does set out a number of exemptions that may prevent
release of the information to you. If any of the exemptions do apply to
the information that you have requested we will not be able to supply it.
You will be notified if this is the case with the reasons why we are
claiming an exemption and your rights to complain and appeal the
decision. 

 

In certain circumstances, the Council may charge a fee to provide the
information requested, to cover costs if photocopying and postage for
example.  If a fee is payable we will inform you of this and you must pay
the fee before the information request can be processed further – the 20
working day timetable is suspended until receipt of the fee. The Act also
sets out the amount of work that the Council can be required to undertake.
If this limit is estimated to be exceeded by your request we can refuse to
process the request. If your request exceeds this limit, we will let you
know. 

 

If any of the information requested concerns a third party they may be
consulted prior to taking a decision whether to release the information to
you or not.  
 
We will aim to provide the information to you in the format that you have

last 12 months  All 4 new applications were granted a licence.

 

• Number of licences renewed as a result of an application made in the
last 12 months  All 5 renewal applications were granted a licence.

 

• If appropriate, grounds on which any licence (new or renewal) was

• A copy of each dog breeding licence currently issued.  For the security
of any puppies, we do not provide copies of the licence but there is
summary information available on the register on our website.

sale/purchase of the dog or are records only updated at the time of the
renewal application?  Updated upon renewal unless the numbers have
increased and they are asked to inform us.

 

• What steps, if any, do you take to ensure that each breeder complies
with The Microchipping of Dogs (England) 2015 regulations?  The microchip
records are checked on each licence renewal and the vet physically checks
them on new applications. On visits we will ask to see any litters that
have occurred and the arrangements in place for microchipping.

 

• Number of staff employed to conduct inspections during last 12 months 2
with regards to the breeding of dogs licences.

 

• Total number of inspections conducted during last 12 months 9 licensing
visits

 

• Number of litters produced (and number of puppies in each litter) by
each licence holder This information is not held.

 

• If you keep records of Kennel Club Assured Breeder Scheme members please
confirm which licence holders are also members of this scheme

We currently have 4 Kennel Club Assured Breeders, they are licence numbers
CBCAAL/003, 024, 040 and 073.

 

• Price charged for new licence £200 (£130 application fee and £70 licence
fee) + veterinary inspection fee

 

• Price charged for renewal of a licence £200 (£130 application fee and
£70 licence fee)

 

• Has any licence been revoked or suspended in the last 12 months? If so,

• Number of complaints received in the last 12 months and the name of the
licence holder complained about. Where a complaint has resulted in

           We have had no complaints regarding a licensed dog breeder in
the last 12 months.

Informal Complaints Procedure

If you are dissatisfied with the way in which your request has been
handled please contact me, and I will try to resolve your complaint on an
informal basis within 15 working days.

If you are then still dissatisfied with the response, please follow the
formal complaints procedure below.

Formal Complaints Procedure

Put your formal complaint in writing, providing any supporting evidence,
to the Customer Experience Manager at the address noted below, who will
then investigate and respond to your complaint within 20 working days.

If the Customer Experience Manager dealt with your initial request for
information your complaint will automatically be referred to the Head of
Service and / or one of our Strategic Directors for independent

Dear [email address],

I do not agree that the licences can be withheld. The name of the licence holder and is already listed on your register of animal activity licenses. I do not need to have the address of any licensed premises. I do require details of the number of dogs kept for breeding by each licence holder and details of any conditions attached to the licence. For example, a number of councils limited the number of litters on the regulated premises at any one time.

Please now provides copies of all current licences.

Dear Martina,

Further to your email below, please find attached the current Dog Breeding licenses requested. Please note, these have been redacted to remove the personal data. License holders names are detailed on our online register, and addresses are withheld for the security of the dogs.

Also attached are the standard conditions which are supplied with each license.
Our Health & Safety and Business Engagement Manager, from the Regulatory Service, has also noted: The Licence state how many breeding bitches are allowed on site, which in turn controls the number of litters they can have. Discussions will be held regarding the number of litters licence holders can deal with at any one time.
