• Number of applications for a new licence in last 12 months
• Number of applications for a licence renewals in last 12 months
• Number of new licences granted as a result of an application made in the last 12 months
• Number of licences renewed as a result of an application made in the last 12 months
• If appropriate, grounds on which any licence (new or renewal) was refused.
• A copy of each dog breeding licence currently issued.
• Please confirm the number of staff and qualifications of staff employed by each licence holder (for the avoidance of doubt I am not requesting any details of individual staff, just number employed by each licence holder and the qualification(s) held)
• When applying for a new licence or a renewal which of the following do you require in respect of the animals specified in the licence
o Name
o Gender
o Age and/or date of birth
o Microchip number
o Breed
o Description
o Date of purchase
• Where a breeder buys/sells a breeding dog during the period of an issued licence do you require them to notify you of the change at the time of the sale/purchase of the dog or are records only updated at the time of the renewal application?
• What steps, if any, do you take to ensure that each breeder complies with The Microchipping of Dogs (England) 2015 regulations?
• Number of staff employed to conduct inspections during last 12 months
• Total number of inspections conducted during last 12 months
• Number of litters produced (and number of puppies in each litter) by each licence holder
• If you keep records of Kennel Club Assured Breeder Scheme members please confirm which licence holders are also members of this scheme

• Number of complaints received in the last 12 months and the name of the licence holder complained about. Freedom of Information Act 2000 – Internal Review  

Your request for an internal review has now been completed and I write to
provide the Council’s response. 

We firstly apologise for the significant delay in providing this response.
Whilst we would not wish to make any excuses for this delay, the
Environmental Health team which has provided the information for this
request are a front line and critical service in responding to
the Covid-19 pandemic in our local community and therefore have had to
prioritise their work accordingly. We kept in touch with them to progress
your request, however, the demand on their service, as well as resourcing
issues caused by absence and self-isolation requirements due to Covid-19
restrictions, has been considerable.

The information you have requested is detailed and responded to below. 

•  Number of applications for a new licence in last 12 months 5 

•  Number of applications for a licence renewals in last 12 months 11

•  Number of new licences granted as a result of an application made in
the last 12 months 3

•  Number of licences renewed as a result of an application made in the
last 12 months - 6 (5 pending)
•  If appropriate, grounds on which any licence (new or renewal) was
refused. None
• A copy of each dog breeding licence currently issued. 

Please see attached. You will note that we have redacted the full
addresses of the licence holders. The Council is withholding that
information and full details of the litters each licence holder has
produced since we consider that the exemption under section 31(1)(a)
Freedom of Information Act 2000 applies to it. This exemption applies
where disclosure of the information would prejudice the prevention or
detection of crime. The council considers that the release of this
information would increase the risk of criminal activity specifically
puppy theft.

While we believe the exemption in Section 31(1)(a) applies in this case,
we are still be obliged to release this information in response to your
request if the public interest in disclosing the information outweighs the
public interest in maintaining the exemption. Carlisle City Council
acknowledges the significant public interest in openness and transparency
and therefore recognises that any request under Section 1 of the Act is
potentially in the public interest. However, disclosure of this
information could potentially facilitate criminal activity and so consider
the public interest is best served by withholding the information.

The Council has also redacted the signature of the authorising officer as
we consider this to be personal information and therefore consider that
the exemption under section 40(2) applies to it. Section 40(2) of the
Freedom of Information Act 2000 provides that:
 
“(2) Any information to which a request for information relates is also
exempt information if—
(a) it constitutes personal data which does not fall within subsection
(1), and
(b) the first, second or third condition below is satisfied.
(3)(a) The first condition is…that the disclosure of the information to a
member of the public otherwise than under this Act would contravene —
(i) any of the data protection principles, or…”
 
In this case we believe that full disclosure of the information would
result in a breach of Article 5(1)(a) of the General Data Protection
Regulation where the information must be processed lawfully and fairly;
there being no suitable lawful basis for processing under Article 6 to
allow for disclosure. We furthermore do not believe it would be fair to
disclose the information.
As a result, we are refusing to provide the authorising signature under
section 40(2) read in conjunction with section 40(3)(a)(i) of the Freedom
of Information Act 2000. This exemption is absolute and therefore not
subject to the public interest test.

details of individual staff, just number employed by each licence holder
and the qualification(s) held) - None of the licence holders employ staff
