Further to your Freedom of Information request received on 11th October
2021, please find below and attached our response to your questions.

Would you please provide an electronic copy of each of the following:

 

1.    Disability Related Expenditure (DRE) Guidelines 2020-2021

Response:

DRE detail is our starting point for holding an individual conversation
with a person to identify any additional expenses that they incur as a
direct result of their illness or disability, i.e. over and above the
expenses that a person without an illness or disability incurs. The
monetary values are agreed at national level with all local authorities as
our starting point. We then have an individual conversation and tailor the
DRE accordingly.

 

2.    Government guidelines regarding fuel costs as Disability Related
Expenditure

Response:

Annual inflationary update based on RPI Fuel index at November 2020. 

 

The figures are obtained from [1]www.statistics.gov.uk. This is what all
local authorities apply in Disability Related Expenditure (DRE) for fuel
costs, we allow the difference i.e. any additional costs incurred as a
direct result of illness or disability as opposed to the costs incurred by
someone who does not have an illness or disability.

 

3.    Any NYCC internal policy, procedure and guidance related to needs
assessments, carer assessments, financial assessments, disability related
expenditure, care and planning and personal budgets.

Response:

I can confirm that the county council holds this information, however it
is exempt from disclosure by virtue of Section 40(2) of the Freedom of
Information Act 2000 (amended by Schedule 19(58) of the Data Protection
Act 2018).

Section 40 (2) of the Freedom of Information Act 2000 exempts personal
information from disclosure if disclosure would breach one or more data
protection principles specified by Section 5(1) of the UK General Data
Protection Regulation (UK GDPR). In this case we consider that disclosure
would breach the first principle, namely that personal information must be
processed lawfully, fairly, and in a transparent manner in relation to the
Data Subject. In this case we consider that the disclosure would be unfair
and none of the conditions for processing, listed in Articles 6 and 9 of
the UK GDPR, would be met.

This exemption is an absolute exemption and therefore not subject to the
Public Interest Test.

 

 

 

We hope that this adequately answers the questions you have raised.
However, please find attached the Council’s appeals procedure for your
information should you not be satisfied with our response.
