Documents of obligation regarding deaths of claimants

Response to this request is long overdue. By law, under all circumstances, Department for Work and Pensions should have responded by now (details). You can complain by requesting an internal review.

Dear Department for Work and Pensions,

Background:
In your ref FOI2020/57824 dated 30th October 2020 you informed us a "Duty of care is strictly a legal term" and DWP "has no legal duty of care" to its sick and disabled customers. However you have also admitted to conducting over 200 secret reviews into the deaths of claimants over the last decade. (Source for public https://www.disabilitynewsservice.com/dw...)

FoI request part 1(A)
Since you say you have no duty of care, please kindly provide a copy of the document which obliges you to carry out these reviews into the deaths of claimants.

FoI request part 1(B)
Please kindly provide a copy of the document which obliges you to keep the above reviews secret.

Yours faithfully,

Amanda Hart

Dear Amanda Hart,

I am writing in response to your request for information, received 11th
June.

Yours sincerely,

Dear Department for Work and Pensions,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department for Work and Pensions's handling of my FOI request 'Documents of obligation regarding deaths of claimants'. Ref FOI2021/47382.

Thanks for your response to our request. We thank you for the information you have provided to answer part 1(A).

We wish to turn our attention to part 1(B) in which you say there is no documentation which obliges you to keep these reviews secret. We do not accept this. There is a wide list of articles published by a variety of outlets referring to how you handle such cases as 'secret', 'secretive', 'shrouded in secrecy'. Your department must therefore be following a protocol and we want to see it.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/d...

Yours faithfully,

Amanda Hart

Dear Department for Work and Pensions,

Re: IR2021/57044
Thanks very much for your response. We appreciate that no personal information can be shown in relation to these internal process reviews but what we're referring to is the fact that you are not publishing things such as the numbers of these reviews as they happen. Therefore there must be a policy being followed here. As you have not provided it we must now take this up with the Information Commissioner.

Yours faithfully,

Amanda Hart
