Further to your request below (ref: RFI 3263), we are writing to advise
that we do not hold any returns information for the Dormouse mitigation
licence for Sedlescombe Road North (ref: 2015-8387-EPS-MIT). The current
licence is not due to expire until 31 March 2025, and we would not usually
expect the licence return form to be returned until two weeks after the
expiry date.

 

Ecologists do often submit return forms halfway through the licence
period, providing an update of any works completed, however we can confirm
that no returns data has been submitted at this stage for the Sedlescombe
site.

 

We can however provide you with a copy of the Method Statement, which does
contain some details of surveys carried out before the application was
submitted to us. Please can you therefore confirm if you would be
interested in receiving a copy of this document?

For your information there is no requirement to familiarize the licence holder with any literature on Dormice, beyond the guidance provided on the licence.

I would point out your licence under General , point 1. Persons acting under this licence must abide by the most up to date iterations of relevant species guidance in this context the relevant species guidance includes:
(i) The advice in the "Dormouse Conservation Handbook (see 'Licence Note' a).

Which is incorrect as it should be b) under Licence Notes where b) The Dormouse Conservation Handbook is available from Natural England Website

I am quite aware that this document you have just supplied me the Dormouse Conservation Handbook is not available on your website and is out of print. I do not understand how this licence can be we complied with legally and must therefore be in breach of its license terms and therefore acts of cruelty have been occurring without license conditions being met. I am asking you to supply therefore all enforcement documents in reference to this License 2015-8387-EPS-MIT.

As you have been able to provide photographs from the studies and said they are with the Ecologist can you please provide the company name who the Ecologist worked for.

which we received on 02 March 2016. Your request has been considered under
the Environmental Information Regulations 2004.

 

I can confirm that we do not hold any of the information requested and any
photographs we hold were provided to you within the Method Statement sent
to you in response to your request number RFI 3263 on 23 February 2016. 
We are therefore applying exception 12(4)(a) – Information Not Held -
under the Environmental Information Regulations 2004. This exception is
applied when the public body does not hold the information requested.

 

The only details we hold in relation to the consultants details can be
found on page 2 of the document titled “Licence
2015-8387-EPS-MIT_Redacted” which was also provided to you in response to
your request RFI 3263.  The only name we have was for that of a private
individual and this was withheld under Regulation 12(3) for the reasons
stated in our response letter to you.

 

May I apologise that the deadline date given to you by my colleague was
incorrect due to the Easter bank holidays. The actual deadline is 04 April
2016 not 30 March 2016 as initially stated.
