I refer to your request for information submitted to us on 24 April 2019.
You have asked for:

 

“all documents (including hand-written notes) relating to the recent
inspection of Steiner Academy Frome. I would also like details of any
communications with the Department for Education relating to Steiner
academies in England.”

 

We are dealing with your request in accordance with the Freedom of
Information (FOI) Act 2000. We have been reviewing the information you
have requested, and it has become apparent that the subject matter
captured by the second part of your request is very broad and will cover a
wide range of our work over a long period of time.

 

To locate details of any communications with the Department for Education
(DfE) relating to Steiner academies in England would require us to
approach a wide variety individuals and teams across Ofsted. Each team or
individual, as appropriate, would need to manually search a large number
of files and email accounts over a long period of time. They would then
need to assess the results of those searches and extract information
within the scope of your request. This would take a significant amount of
staff time.

 

Section 12(1) of the FOI Act states that a public authority is not obliged
to comply with a request for information if it estimates that the cost of
complying with the request would exceed the appropriate limit (£600,
equivalent to 24 hours of staff time). If the cost limit can be applied to
any one element of your request, then the whole request will come under
the limit and we cannot respond to your request in full. Therefore, if we
proceed with your request in its current form, our position would be to
refuse to provide any of the information as to do so would exceed the
limit above.

 

Where a public authority, such as Ofsted, is considering the use of
section 12, it is obliged under section 16 of the Act to provide advice
and assistance to the individual making the request, where possible. On
this occasion, we cannot identify an obvious way in which you could narrow
your request to bring it within the cost limit, as we do not know the
specific focus of this aspect of your request. We are therefore contacting
you to ask whether you wish to narrow or revise the scope of your request,
so that it may be adapted to be answerable within the cost limit. We are
also asking you to provide some clarification of the information you
intend to fall within the scope of the information being requested.

 

We would be grateful if you could consider this email and inform us how
you wish to proceed with your request. If you wish to submit a refined
request, we would be happy to take this forward for you. If you do not
narrow or revise the scope of your request by 21 May 2019, it is likely we
will have to issue a formal refusal notice under section 12 of the Act.
That will not, however, prevent you from submitting a revised request
after that time.
