Thank you for your request dated 22 April 2016 under the Freedom of
Information Act 2000 (FOIA).   Unfortunately there are some limitations to
our data that mean we won’t be able to answer your question as it
stands.  

We could provide a list of doctors who currently have restrictions,
undertakings, etc, who have registered home addresses in Leicestershire
(eg postcode LE..), however we don’t hold doctors’ private addresses
historically.     

 

Similarly we record doctors’ connections to designated bodies (DB)
geographically;  most doctors are ‘connected’ to a DB (eg a NHS Trust) for
the purposes of professional revalidation.  This data goes back to 2012.
 Not all doctors are connected, but it is a good proxy measure.  So we
could link doctors with sanctions to DBs based in the Leicester region,
currently, and back to 2012.

 

Finally, we do hold some employer data, current and historic, which would
indicate geographic base, but this is not comprehensive and only covers
the NHS, not the private sector.

 

If you could please clarify what information would best meet your needs,
this would assist me in responding to your request.

 

I should add that formal sanctions on doctors’ registrations are
accessible on the public register at

about a particular doctor’s registration status you can check this.

Thank you for your emails asking for a list of doctors in the Leicester
region with restrictions on their registration, from 2012 to date.   I’ve
considered your request under the Freedom of Information Act 2000 (FOIA).

 

We carried out searches on our case management database for doctors
connected to a Designated Body (DB) in the Leicester area for each year,
who had sanctions effective on their registration during that year,
following fitness to practise investigations.  This summarises the total
number of doctors identified for each year.  This indicates that they were
subject to the restriction during that year; it may have been imposed in
that year, or earlier.  The figures will exclude doctors in the Leicester
area who were not connected to a DB. 

 

2012 19 Doctors Dec 2012 only, when connection to DBs commenced

2016 21 Doctors Year to date

 

Within these total figures, I can give you details of only some of the
doctors.   The attached list shows the names and identity numbers of
doctors whose sanctions are currently published on the List of Registered
Medical Practitioners ([1]LRMP).  For instance for 2012, out of the 19
doctors who had restrictions, I can only give you details of 8 of them.  I
can’t provide the names of doctors whose restrictions don’t currently
appear because it would breach the Data Protection Act 1998 (DPA) to give
this to you. If a case progresses to a public hearing, or the doctor
receives a sanction on their registration, certain information may be made
publicly available by the GMC. Some sanctions, such as conditions imposed
by Interim Orders Panels, appear only temporarily on the register.
 Otherwise the information is treated as the confidential personal data of
the doctor and other parties involved. I’ve given details of the exemption
under the FOIA which applies below.

 

The exemption:  Section 40(2), by virtue of section 40(3)(a)(i):  This
exemption applies where the information is the personal data of a third
party and where releasing the information would breach any principle of
the DPA. In this instance disclosure would breach the first principle of
the DPA, which requires the processing of information to be 'fair and
lawful'. I believe the conditions in Schedule 2 of the DPA, which are
about the processing of personal information, are not met

and therefore giving you the information would be unlawful.

 

The attached list shows some doctors more than once in a year, for example
if they have had conditions imposed on multiple occasions.   Some doctors
appear in consecutive years, for example a warning will be published for 5
years.   For further information about what information is published about
doctors, please see our [2]Publication and Disclosure Policy.

 

Finally you also asked about individual doctors’ designated bodies.    You
can look at their LRMP entry under Revalidation to find this.  If you
wished to know about a doctor’s DB history, you would need to make a
request to us at [3][GMC request email].
