Do the Nurse and Midwifery Council ever investigate criminal acts committed by the NMC's Nurses
Dear Nursing and Midwifery Council,
Under the Freedom of Information Act, please provide a formal response from the Nurse and Midwifery Council to the following questions:–
1. How many complaints have the Nurse and Midwifery Council received concerning Psychiatric Nurses within the year :-
a) 2014
b) 2015
2. How many complaints have the Nurse and Midwifery Council investigated that involved Psychiatric Nurse within the year :-
a) 2014
b) 2015
I understand that under the Freedom of Information Act, I should be entitled to a response within 20 working days.

I am making the above request following the Nurse and Midwifery Council (NMC) refusing to investigate the Psychiatric Nurses that have illegally accessed, illegally altered, illegally distributed, etc. mine and my sister’s personal / medical records held by the Aneurin Bevan Health Board / NHS.

Following the Aneurin Bevan Health Board (ABHB) finally releasing,after 8 months my information relating to whom, where and when accesses had taken place into my health records (It took the ABHB 5 years to provide my sister with her list). I asked my GP’s Surgery to examine the lists provided by the ABHB and confirm whether or not there were corresponding records held at my surgery. As I knew the alleged treatments were inaccurate and the accesses were illegal.
My GP Surgery provided me with a letter and breakdowns from the Surgery confirmed that there are no records sent to my surgery by the NMC’s Nurses / ABHB relating to the treatments the NMC’s Nurses / ABHB allege they provided at the time and date recorded in the ABHB records (or at any other time).
I present the NMC with this and other condemning evidence against the NMC’s Nurses, only for the NMC’s Screening Manager Tim Horner to close the complaints and refused to investigate the illegal acts conducted by the NMC’s Nurses.

I note that the automated response from the NMC has requested that freedom of information requests are redirected to a different email address.
I have updated our website such that any future Freedom of Information request made via this website will be sent to the new e-mail address. However there is no doubt that the original Freedom of Information Request was correctly sent and received on the 13th April.

"For a request to be valid under the Freedom of Information Act it must be in writing, but requesters do not have to mention the Act or direct their request to a designated member of staff. It is good practice to provide the contact details of your freedom of information officer or team, if you have one, but you cannot ignore or refuse a request simply because it is addressed to a different member of staff. Any letter or email to a public authority asking for information is a request for recorded information under the Act."
The NMC clearly received the request, as both our server logs and their automated response makes entirely clear. Though they may now request that such requests be sent to a different contact, they are not legally permitted to ignore requests sent to the original request - as long as it's in writing and an employee (any) has received it, the FOI request has been correctly sent and they are under an obligation to respond to it.
