Please could you also provide copies of any correspondence between HMRC and the BBC sent in the last twelve months which
refer to the subject of dispensations.

A dispensation is a notice from HMRC that removes the requirement to report certain expenses and benefits at the end of the tax year on forms P11D or P9D. Dispensation documentation is held by the BBC for the purposes of tax administration and not for the purposes of journalism, art or literature.

You have written in connection with my request for an internal review that: "The 20 working days recommended by the Information Commissioner's Office is not a legal deadline with which we must comply-we do however endeavour to process internal reviews within 30 working days."

I note that the BBC has already broken the law in connection with its request by failing to provide the information I requested or a valid refusal notice within twenty working days of my request being made.

Given this chain of events I feel it is not unreasonable on my part to request that you conclude the internal review in the time scale which the independent regulator of information rights (the ICO) considers to be reasonable.

As they have already failed to comply with the 20 working day statutory timeframe for response you could ask for a Decision Notice from the ICO, which would censure them.

It's a prima facie case - they have failed to respond in the manner the law dictates, so the ICO is obliged to issue a Decision Notice against them.
