Disclosure of Progress Reports for the Knowle

Dear East Devon District Council,

Dear East Devon District Council,
Dear Mrs Symington,

I would like to make a formal request under the Freedom of
Information Act 2000. I am also making this Request under the
Environmental Impact Regulations 2004 which require disclosure on
the part of Local Authorities.

I would like you to provide me with the following:
> I would like access to the full Relocation Manager’s formal
progress reports, including the Davis Langdon reports and any other
complete, unredacted reports presented to the working parties with
regard to the relocation project to date .

> Reports, Action Notes and Updates on the relocation have been
presented to most Cabinet meetings over the last four years.
However, the full content of these documents has not been given in
full in the Minutes: only their ‘receipt’ and ‘acceptance’ are
recorded. I would like to have access to the full content of these
Reports, Action Notes and Updates from 2011 to date which refer
specifically to relocation.

EDDC cannot claim that it should withhold this information on the
premise that matters are still ‘open’. It is absolutely clear that
definitive steps have now been taken by EDDC to reach a formal
decision to relocate following he full EDDC Council meeting on the 17th December 2014.

The minutes of this meeting make it clear that EDDC have decided to
relocate from Knowle – and, now that this decision has
been made, all documents relating to that decision should now be
made fully available to the public.

My apologies for not coming back to you sooner. The decision has not yet been taken to move - that is a matter for Council on 25 March and, following this, we will be reviewing all past documentation with a view to publishing where appropriate.

As you are aware, the First Tier Tribunal is currently considering the matter of the re-location manager's progress reports and the Council will take necessary action following the outcome of this case

I hope this is helpful for now and I will be in touch with you again once we know the outcome of the first tier tribunal case so that we can progress that aspect of your request.

Dear East Devon District Council,
I asked for the release of all Progress reports on the Knowle relocation . On 19th March 2015, you said that you would take all necessary action following the release of the judgement of the First Tier tribunal. Their decision has now been made and EDDC has lost their appeal against release.. Progress reports must now be released.

Full Council has also now decided to re locate.

Please now let me have copies of these Progress Reports to date as requested.

Thank you for your email.

In terms of the reports which have been subject to the case to the first tier tribunal, the Council will make these available in line with the timetable which has been ordered by the Judge. This will not be until after the time for an application for permission to appeal, and any such appeal has been determined or discontinued. If no application for permission to appeal is made by any of the parties, the reports will be published after this 2nd June deadline.

With regard to the remainder of your request, the Council is currently reviewing historic project information as part of our stated commitment to publish at appropriate project milestones. We plan to release documents in stages, the first tranche of which will be published online within the next 2 weeks.
