Dear Health and Safety Executive,

I am writing to HSEGB in relation to the new contract for Gas Safe Register due to commence 1/4/2019 and the requesting details on the following items under the Freedom of Information Act.

I am requesting this to insure this time round Northern Ireland is not placed in a severely deficient contract by HSENI where registered companies were charged for services which were not delivered by the operator with the full knowledge and support of HSENI.

I am seeking to observe an exact mirror service in Northern Ireland as is provided in GB in every way to insure equality and safety of the general public in Northern Ireland which the current contract totally fails to support, to this end we request the same data from HSEGB who have been much more open in assisting in our efforts to uncover the failings in NI.

1. Proposed method of engagement with the trade something that has been totally nonexistent under the current contract both in GB and NI? Please detail fully procedure for selection of trade representation to insure as is common with government bodies only Yes people are appointed to insure difficult questions are not asked and transporters and manufacturers can run riot and rewrite the rules to suit themselves placing as usual gas engineers in the most vulnerable of positions as we are seen as bottom feeders in the food chain.
2. How are HSEGB or HSENI plan to insure value for money, to insure funds are not siphoned off through group companies providing services to the register operator and not over charging thereby taking funds outside the remit of the accounting returns for the register operator. Will there be a need to prove that services purchased in from within a business group are value for money and not just a method of skimming profit?

2a. Would forensic accounting be put in place to demonstrate transparency and honesty something HSENI & HSEGB are both keen to promote and justify and put to bed any financial irregularity concerns and publicly publish findings on a annual basis?

3. Will there be a set percentage of turnover for public awareness? Again this expenditure should not be within the business group or with companies where there is a shareholding or control.

4. I would seek to see details of all services to be provided under the proposed contract?

A. Number of inspections?

B. Details of trade engagements and payments to event (trade show organisers) for stands and not bully and demanding stands for attendance?

C. Transparency and democratic voting reflecting the makeup of the trade and the register operator does not always act to the benefit of transporters OR manufacturers ?

D. Proposed method of measurement of performance in each region and the Key Performance Indicators and targets set? What will the targets be per region?

5. Method of inspecting businesses and engineers on site and the ending of "SS style" camp inspections where the issued documentation indicates the hotel inspections where work inspections on site which they were not? Only a work inspection allows the operator to see the engineer is properly equipped, manor and approach to work etc. One hour of lecturing and then handing out an examination paper most of the general population could pass that assessment without any knowledge of gas but was purely a cheap method to maximise profits.
A. Under the current scheme the mass events who drew up the examination paper?

B. Was the person delivering the lectures a qualified lecturer and assessor?

C. Which examination body approved the examination/assessment questions?

D. Did HSENI and HSEGB agree to the mass events and miss reporting of the assessments events?
E. Why were these events required? Was CGRAS behind of auditing as some registered businesses that had not been inspected in ten years?

6. The proposed method to limit influence of non trade related bodies that is boiler and equipment manufacturers, Co alarm manufacturers, builders, developers, Landlord Associations who do not directly work on gas appliances? Whilst we understand appliance manufacturers may employee hands on staff their influence to change standards needs to be clearly separated to prevent another fiasco of transfer of liability as seen in TB008.

7. Proposed action to crack down on illegal work as illegal’s have nothing to fear from current operator and in fact makes financial sense as the register operator only targets registered business? We would expect to see the performance in this sector one of the KPI’s to be measured to see if something is actually being done?

8. Will there be a requirement to insure that commercial information for operators of these types of premises is available on the website of the register and the current site is virtually devoid of this type of information at present?

9. Will there be a quarterly refresh of the Register website as only recently CGRAS update the website which had lay virtually untouched for two years? Should be a KPI?

10. At what date was it confirmed that CGRAS were the successful applicants to run the licence in Northern Ireland ?

11. Can you confirm who were the other applicants who were unsuccessful in the tender process if for the Gas Safe Contract if for ant reasons these names cant be released or disclosed just inform me in figures how many other tender licence applicants there were?

12. Can HSEGB confirm that the licence tender application process for the Gas Safe licence was not in any corrupt and dirty deals were in no way done and the selected applicant won the licence on merit and no palms were lubricated to allow the successful applicant to win the tender?

13. Can HSEGB confirm of how many investigations have taken place in relation to farming and associated farming practices in the last 5 years?

14. Can HSEGB confirm how much financially has it cost in £ in relation to farming investigations and associated farming practices in the last 5 years?

15. Can HSEGB confirm of how many investigations have taken place in relation to Asbestos and Asbestosis in the last 5 years?

16. Can HSEGB confirm how much financially in £ has it cost in relation to Asbestos and Asbestosis in the last 5 years?

17. How much money in £ has HSEGB spent on "Entertainment" this includes travel, venue, entertainers, drinks, food and any other conceivable attachment to entertainment from...

A. 2012/ 2013

B. 2013/2014

C. 2014/2015

D. 2015/2016

E. 2016/2017

F. 2017/2018

G. 2018 to Current Day

By law the Authority (HSE) should have responded within the "Long Stay" 20 day time frame as set out by current GDPR regulations but too often our government body (HSE) simply ignore the very legislation they are suppose to abide by so stop procrastinating and answer the simple question put before you.

i will allow a further 3 days to demonstrate to the ICO of my consideration and i will also like to note that no extension of the "Long Stay" time period has been requested by our HSE.

failure to comply to my lawful request will result in a lodgment under "casework" to the ICO and the details contained within this Freedom of Information Request will be forward for their unbiased judgment.

HSE should also take on board the time frame of 20 days is the Maximum time it should take to provide the requester with the information but again all too often government bodies run around like headless chickens on the 20th days trying to collate the requested information and only partial replies are provided, then clarity questions are asked of the requester where an additional 20 days are also applied.

simply if the information requested can be provided within the Long Stay time frame as an authority you are Legally obliged to provide it.

[ It is very clear yet again a partial reply has been given and all the set questions have not been answered, I have submitted my questions and I want them ALL answered.

As explained in the internal review acknowledgement letter, HSE endeavours to respond to internal review requests within 20 working days. In this instance that would be by 14 December 2018. That is not to say that it will take that long. It all depends on the current volume of internal reviews and the availability of staff to conduct them.
