Disclosure of Evidence
Dear Lambeth Borough Council,
The London Tribunals' Practice Manual for Enforcement Authorities requires full disclosure quote 'para 7.2 It should be noted that the EA must make full disclosure. It must therefore submit all items of correspondence and evidence in its possession relating to the appeal, including items that might assist the Appellant, irrespective of whether the EA considers it to be relevant or not.'
On 4 and 7 December 2015 Adjudicator Anthony Chan upheld 2 appeals at the Clapham Park Road bus lane because a no entry sign had been reversed and was facing the oncoming traffic in the lane the council expect motorists turning left to use. This reversed No Entry sign is visible in CCTV images taken of alleged contraventions from May 2015 until the sign was corrected in December 2015.
The reversed No Entry sign is not mentioned by the adjudicators in most of the appeals that have been rejected since 7 December 2015.
My question is has Lambeth Borough Council followed the above requirement to disclose details of the reversed No Entry sign in evidence submitted to London Tribunals in appeals heard since 7 December 2015 for alleged contraventions at the Clapham Park Road bus lane during the period the No Entry sign was reversed (ie May - December 2015). The reversed No Entry sign is clearly relevant to these cases as stated by Mr Chan.
If you have not disclosed evidence of the reversed No Entry sign can you explain why you have not done so as this will have prejudiced the appellants in those cases.
