Dear Welsh Government,
Please disclose the letter to UK energy secretary Greg Clark and all documents relating to the political support for a project that’s much more costly than some other renewable sources, and to the offer of £200million equity and/or loan investment by the Welsh government. Please justify the statement in the letter on “ appropriate balance between supporting a pathfinder project … while providing value for money”. Please supply justification for making such an offer outside the normal competitive tendering process and the need to demonstrate value-for-money. The documents will need to go back several years and show what regard has been paid to sustainability and to environmental impacts, including NRW’s objection to the TLP scheme. Please ensure all correspondence, e-mails and reports of phone-calls and meetings with TLP are included.

I am writing to request an internal review of Welsh Government's handling of my FOI request ATISN 12578 'Disclose documents relating to Carwyn Jones’s political and funding support for the Swansea Lagoon project'. Your official reply is very negative, seeking excuses against disclosing anything rather than seeking to disclose documents with redactions of sensitive or exempt points.

The refusal wrongly cites the FoI Act s.28 to refuse information covered by the Env Info Regs. You earlier released e-mails to BEIS in ATISN 12166 from 1 Jan to 1 March. The matter has since been concluded, so there is no longer a 'sensitive' issue between BEIS and WG Ministers. You should now release all those e-mails including the replies from BEIS and those before 1 Jan 2108 and after 1 Mar 2018, with redaction of personal information of non-senior officials as necessary.

It is not credible that an offer of £200Million equity investment (Point 2) can be made on the basis only of the BEIS assessment of value for money cited, with no summary case and with no regard to sustainability and to environmental impacts (including NRW’s objection to the TLP scheme) in the Welsh policy context. Please reconsider the non-disclosure of all the documents are caught by my request; please list them with title and date and the particular exemptions claimed for each, including why copies with appropriate redactions are said not to be possible.

No public interest evaluation given for withholding data :

7. As with all EIR exceptions, this is a qualified exception. Even if the exception is engaged, public authorities must go on to apply the public interest test set out in regulation 12(1)(b). A public authority can only withhold the information if the public interest in maintaining the exception outweighs the public interest in disclosing the information.
8. Regulation 12(2) specifically states that a public authority shall apply a presumption in favour of disclosure.

A significant part of the information I seek has been posted online by the English government, according to Private Eye (p.13, 2nd Nov.) being the successive 'brazen' demands of developer Mark Shorrock for increasing levels of subsidy. Apparently he demanded £482M from the Welsh Government rather than the £200M offered. What does that say of the Welsh Govt refusal to disclose documents relating to its defunct offer? The review decision promised by 9th November is now overdue.

This very negative refusal shows the WG does not apply the FoI requirement to be "helpful".
They did not supply as I asked

## BEIS has lifted non-disclosure agreements on several documents and disclosed key points of TLP’s request for financial support from the Welsh government.
The company requested £200 million loan funding from Welsh government at a two per cent interest rate and up to £261.1 million in annual equity down payments over 35 years.
In return, TLP offered the Welsh government 90 per cent ownership of the lagoon at the end of the 35-year project’s proposed contract for difference when it would still owe up to £822.3 million worth of outstanding debt.
The Welsh government would have also taken on the costs of maintenance and turbine replacement after about 50 years of operation as well as any decommissioning liabilities.##
The BEIS Factsheet finds that the extra cost of a Lagoon power programme would amount to £15 000 per household in Wales. Little wonder that the Welsh government resists disclosing documents.

The refusal and the first review show breaches of the FoI requirement to be "helpful".
You did not supply as I asked
# documents with redactions of information deemed sensitive or personal
# a list of the documents refused, with specific reason for refusal of each.
You failed to mention a non-disclosure agreement between TLP and the Welsh Government that may not be consistent with the EIR and FoI; because of this, the public would suspect that you prioritise this agreement than FoI law
You failed to point out that part of the Information I requested was put in the public domain by BEIS on 25th June https://www.gov.uk/government/publicatio... and 19th Oct. https://utilityweek.co.uk/government-say...

So the government is admitting they didn’t bother to evaluate the project - before spending hours and hours of public time and money shuffling papers.

WG made no evaluation of value-for-£200M offered, claiming they'd do 'due diligience' after the offer had been accepted.
Not only the First Minister, but other political leaders in Wales vye to commit themselves to the project without any assessment.
