Dear Dumfries and Galloway Council,

Can I clarify that these numbers are due to views on the actual teaching or education of this subject in school and not against a particular protected characteristic group!

Dear Dumfries and Galloway Council,

Please note I do not now require a break down of numbers per school, as I appreciate that the numbers we talking about here are minimal and may identify an individual.

To assist I require the data from academic year 2019/20 to date broken down AY on AY.

Yours faithfully,

FOI Responses, Dumfries and Galloway Council

PUBLIC

Good morning,

Thank you for your e-mail dated 17 November 2022 requesting a review of the way in which the Council handled your request for information for case 5400978 under the Freedom of Information (Scotland) Act 2002 (FOISA) and subsequent email on 28 November 2022 providing further information in relation to this request.

Details of request: Can I clarify that these numbers are due to views on the actual teaching or education of this subject in school and not against a particular protected characteristic group!

Please note I do not now require a break down of numbers per school, as I appreciate that the numbers we talking about here are minimal and may identify an individual.
To assist I require the data from academic year 2019/20 to date broken down AY on AY.

Review response:
Thank you for providing further clarity on what information you are requesting. Unfortunately, in our original response to your request we had misinterpreted the information you were requesting. The figures that we provided within our original response were taken from our Bullying & Equalities area of SEEMiS. This area records incidents, entered by the schools, of pupils who demonstrate or experience a Bullying & Equalities incident during the school day. Within the system the incidents are records under a 'Incident Perceived Reason' which are titled 'Actual or Perceived Sexual Orientation (e.g. homophobic, bi-phobic)'. Therefore these figures relate to pupil incidents for this particular perceived reason.

Upon review of your request and in light of the clarification you have provided, we can confirm that our response to your request is in fact a nil return as we have no trans gender subjects within our schools. Apologies for any confusion and we hope that this now satisfies your request.

If you are dissatisfied with the outcome of the review, you have the right to apply to the Scottish Information Commissioner for a decision if it is within six months of receiving your review response.

Appeals to the Commissioner can be made at
Address: Kinburn Castle, Doubledykes Road, St Andrews, KY16 9DS.
Email: [email address]
Telephone: 01334 464610

You can also use the Scottish Information Commissioner's online appeal service to make an application for a decision: www.itspublicknowledge.info/appeal

You also have the subsequent right of appeal to the Court of Session, on a point of law only, if dissatisfied with a decision issued by the Commissioner.

Kind regards,

Information Governance Team
