Dear ACCESS I.,

As stated in my original query, the timeframe information is requested for is for the most recent academic year, 2019/20, as well as the previous three academic years, 2018/19 2017/18 and 2016/17.

To clarify the information request, I request information about the number of disciplinary panels held regarding matters of academic misconduct. I would request these broken down by year, then per year by faculty, and then per year by which term they occurred in. I would also request information on how many were dismissed without action and how many required disciplinary action, specifically how many students were required to withdraw as a result of the panel hearings.

Yours sincerely,

G. Fry

ACCESS I., Durham University

Dear G. Fry

Thank you for your request for information from Durham University.
Colleagues have provided the information below in response to your
questions.

I request a freedom of information request regarding Disciplinary Panel
Hearings held regarding academic misconduct during the Easter Examination
period.

I request this information for the academic year 2019-2020 and also for
the past three years. This should be broken down by faculty.

Durham University do not hold this information in a central or easily
accessible format.

It is estimated that the time taken to locate, retrieve and extract the
requested information would exceed the fees limit associated with the
Freedom of Information Act 2000 (FOIA). Under Section 12 of the FOIA, the
University is not obliged to comply with a request for information if the
cost of compliance would exceed a £450 threshold, a figure which equates
to approximately 18 hours of work spent searching/retrieving and
extracting requested information.

The university may be able to disclose some of the requested information
if you are prepared to narrow the scope of your request. However, we
cannot confirm at this stage if this would bring your request under the
appropriate limit, or that another exemption will not apply.

If you are dissatisfied with the University’s response to your freedom of
information request, you can ask us to internally review our handling of
your request, including the application of any exemptions applied.  To do
this, please email [1][Durham University request email] or write to:

Information Governance Unit

The Palatine Centre

Stockton Road

Durham

DH1 3LE

Please state the grounds on which you wish the decision to be reviewed and
enclose any other information that may be useful in considering the matter
further.  We aim to inform you of our decision within 20 working days from
the date your request for internal review is received.

If you are not satisfied with the results of the internal review you may
apply to the Information Commissioner's Office for an independent review.

Dear ACCESS I.,

I wish to modify my request in order to reduce the time expectation for my request.

I ask that the disciplinary panel statistics be contained to the Maths Faculty only. I request that this be for the past two years, rather than the three asked for originally. Should two years still prove problematic I request the data for the 2019-20 Easter examination period only.

Yours sincerely,

G. Fry

From Easter 2017 to Easter 2020 inclusive there were eight cases of
academic misconduct considered by the disciplinary panel.

Due to the low numbers involved and in accordance with Section 40(2) of

the provision of this information may enable identification of
individuals.

Dear Durham University,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Durham University's handling of my FOI request 'Disciplinary Panel Statistics'.

My first request was too many hours so I modified the request to narrow the request to within the Maths department. This request was refused as being too few to suggest identification of students. This seems wrong as you can not not identify a statistic.

I request the be looked at again. It seems like blatant refusal and avoidance of the freedom of information act.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/d...

Yours faithfully,

G. Fry
