I today received a response from the Council as follows:

Please see below the response to your enquiry under the Freedom of Information Act (FOIA) or Environmental Information Regulations (EIR) received on 9th December 2020

• Please supply copies of all communications between yourselves and any officer of Disabled Motoring UK that have taken place in the last three years.

Response

Searches have been undertaken within the Councils corporate records management system and throughout Business Travel, Parking and Transport Administration and Blue Badges.

No communication is held.

I am unable to believe there has been no communications as the meeting of the Council Executive, Thursday, 26 November 2020 5.30 pm contained a document https://democracy.york.gov.uk/mgAi.aspx?... Annex 6 - Independent review of York’s access offer, item 59. Which is a report from Disabled Motoring UK that states “Disabled Motoring UK (DMUK) was invited to carry out a desk based independent review of York City centre disabled access offer” with multiple references to the City of York Council as the originator. The ‘Review’ has the date 14th October 2020 embedded. A thorough search should have at least been able to produce that report.

Whilst the document from Disabled Motoring UK gives no clue as to which part of the Council it originates from it is most likely to be from the Directorate of Economy & Place, although the Council’s Communications staff may also have been involved.

Following your request dated the 9^th December 2020 I have now completed a
review of the response to your request under the Freedom of Information
Act (FOIA).
 
My understanding of your concerns about your response is:
 

* You want us to look again at your request as you believe
communications are held with CYC regarding Disabled Motoring UK.

 
Review
 
I shall review your concerns in turn:
 
I apologise that you did not receive a full response to your request. This
is partly due to the request not been sent to all relevant service areas
when we initially received it.
 
I can confirm that the communications held by CYC have now been provided
in this response. If you have any issues opening the documents please let
us know.
 
Some redactions have been made to the information which contains some
personal and third party information. This information is exempt from
disclosure under section 40(2) of the FOIA, because it constitutes
personal data and disclosure would breach the Data Protection Act (the
DPA).
 
In this case, we consider that it would be unfair to individuals and staff
below the level of Head of Service and not in their reasonable
expectations to have their personal details disclosed in response to this
FOIA enquiry, which is a disclosure into the public realm.  We have
considered if there is any legitimate interest in disclosure, which would
outweigh the individual’s privacy rights in this case, but we do not
consider there to be one.
