Dear Children and Family Court Advisory Support Service,

1. If a FCA has admitted to Cafcass customer services that “she had been informed of the service users HEALTH ISSUES” , which are defined under 2010 Equality Act as “physical and mental impairments” that have had ‘substantial’ and long term effects would the FCA and Cafcass customer services acknowledge the service user is “disabled” ?

2. If a service user of Cafcass discloses a “medical condition” on a C100 does the FCA allocated to the case have a duty to “undertake due diligence” ?

3. If Cafcass customer services are aware that a complainant has disabilities do they have a duty to undertake due diligence ?

I am writing to request an internal review of Children and Family Court Advisory Support Service's handling of my FOI request 'Disability Discrimination & Due Diligence’

I am dissatisfied with your response as the link you have provided indeed ‘completely contradicts’ your response. You stated in your response:

“Cafcass Collect diversity data nationally to understand important diversity issues in our work and so that we can build better services both nationally and locally”

Contradicting this your link : “Diversity in cases, including anti discriminatory practice”: 2.46 states:

“ Cafcass does not collect diversity data nationally in respect of service users because we take the view that standard diversity monitoring forms often cannot capture useful information about children’s diversity needs. instead it is the practitioners responsibility to identify Any diversity issues in a specific case in addition to this requirement each Cafcass service and service area has a responsibility to identify the diversity needs of groups of children living in that area where we are involved and to take action accordingly. such local diversity issues should be recorded along with the action taken in local business plans”.

Therefore please clarify your response correctly and accordingly and also please also specifically answer the question in relation to the “due diligence” and the FCA’s specific responsibility to undertake due diligence rather than providing lazy contradictory links to answer the questions.
