Director of Resources and communication relating to police injury pensions
Dear Avon and Somerset Constabulary,
The Director of Resources Julian Kern has delegated responsibility from the Chief Constable to administer the powers and duties of the Chief Constable as the Police Pensions Authority.
I would also ask for copies of any emails, memos, or other recorded means of communication, from Kern to any person holding a HR post which relate to police injury pensions and awards, and the replies to any such emails. I wish for the date period for the disclosure to be from the 1st January 2013 to the present - 10th September.

September 2014 concerning injury pensions and awards. This request will be
dealt with under the terms of the Freedom of Information Act 2000.

Dear Ms Jessick
I write in connection with your request for information dated 10^th
September concerning correspondence between Julian Kern and any person
holding a HR post which relate to police injury pensions and awards.
Specifically you asked: “The Director of Resources Julian Kern has
delegated responsibility from the Chief Constable to administer the
powers and duties of the Chief Constable as the Police Pensions Authority.
I would also ask for copies of any emails, memos, or other recorded means
of communication, from Kern to any person holding a HR post which relate
to police injury pensions and awards, and the replies to any such emails.
I wish for the date period for the disclosure to be from the 1st January
2013 to the present - 10th September.”
Mr Kern did not have delegated pension responsibility until May 2014,
therefore the information has been provided as such. You will notice some
redactions have been made, and one email that was retrieved has not been
provided. In addition one email (dated 19^th August 2014) that had two
attachments which are personal letters. These have also been withheld.
The exemption applicable the email and the redactions is Section 40(2),
third party personal information. This is an Absolute exemption so
therefore there is no requirement to conduct a harm or public interest
test. Any information is exempt from disclosure under the Freedom of
Information Act if it relates to or is supplied by another individual and
disclosure of that information would contravene any of the principles of
the 1998 Data Protection Act, in this particular case, disclosure of this
information would contravene Principles 1 and 2 of the Act, whereby
personal data shall be processed fairly and lawfully and only obtained for
one or more specified purpose or purposes. This does not just apply to
where names appear in the correspondence, it applies to all instances
where an individual can be identified.
