Dear Disclosure Team,

I am afraid you are mistaken.

HMCTS is a different pubic body who I have submitted a complaint to.
Are you not aware of the constitutional principles of the independent judiciary under the separation of powers?

This FI is to MOJ who have not responded and are in breach of their legal duties.

trust you will promptly provide the requested information you hold.

Dear Ministry of Justice,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Ministry of Justice's handling of my FOI request 'Directions as to the listing and conduct for utility warrants of entry'.

You have admitted you hold the information "...any information held by MOJ in relation to the decision of the chief magistrate to issue a practice direction is held for the purposes of the judiciary and so not disclosable under FOIA."

Accordingly this is information that is disclosable under FOI unless you can provide statute or common law authority to not provide the same.

I too would be embarrassed to have provided such advice as appears in the directions in an attempt to avoid holding my hands up!

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/d...

Yours faithfully,

Marc Horn
