Direction and Control -NOT- Organisational issues

We're waiting for Francis Pym to read a recent response and update the status.

Dear Humberside Police,

See the outcome to a Local Resolution complaint (CO/535/17)

"Please be aware that as your complaint refers to an organisational issue there is no right of appeal against the outcome of the Local Resolution process. This is in accordance with Paragraph 8A Schedule 3 of the Police Reform Act 2002."

The complainant is denied an appeal right on account of the force classifying the complaint as "an organisational issue". The correct term for a complaint which has restricted appeal rights is Direction and Control (not Organisational issue).

Please note paragraph 3.24 of the IPCC statutory guidance:

"The IPCC considers the term direction and control to mean general decisions about how a force is run, as opposed to the day-to-day decisions or actions of persons serving with the police, which affect individual members of the public – including those that affect more than one individual. ‘Conduct’ includes acts, omissions, statements and decisions."

The complaint categorically concerned a 'Conduct' matter and was therefore dealt with under the wrong classification.

1) How does the force manage to get such fundamental decisions wrong?

2) What remedy is offered when such an error comes to the attention of the force?
