Under the Freedom of Information Act:

1.Please provide a copy of your policy regarding the trialling of SEN Direct Payments and personal budgets.

2.Please confirm whether all parents/carers issued with a new or amended statement since January 2012 have been informed about their right to apply for a Direct Payment for SEN provision under the Special Educational Needs (Direct Payments) (Pilot Scheme) Order 2012. How has this information been provided? Please provide a copy of any standard leaflet or letter issued together with confirmation of the date of issue.

3.Please confirm the number of parents/carers who are receiving SEN Direct Payments and what those Direct Payments relate to.

4.Please confirm whether any of these SEN Direct Payments could be provided outside the Pathfinder project, e.g. payments under Part 6 of a statement for transport.

5.Please provide a copy of your policy for considering requests for direct payments for SEN provision. If you do not have a policy, please confirm whether there are any limits placed on direct payments applications, e.g. they will not be provided if the LA has a block contract or there is a financial limit. Please confirm whether these criteria are communicated to parents and provide a copy of that document .

6.Please confirm your arrangements for reviewing appeals against a refusal of a request for SEN Direct Payments. Please provide a copy of any policy and any leaflet/letter issued to parents explaining this.

7.Please confirm what information is provided to parents/carers about the trialling of personal budgets. Please provide a copy of any leaflet or letter issued.

8.Please confirm how many parents/carers are receiving a personal budget within the auspices of the Pathfinder project?

9.Please confirm how parents/carers in receipt of SEN Direct Payments/ personal budgets obtained the information to make an application. For example, were they:

(a) sent the information with a new or amended statement
(b) recruited as part of a specific pilot
(c) neither (a )or (b), the family approached the LA having heard about SEN Direct Payments/personal budgets from other sources

10.Please provide a copy of your local offer.

Response: The SEND Pathfinder has adopted a policy of person centred
testing of all aspects of the reforms including Personal Budgets/Direct
Payments (PB/DP) as we trial the reforms. As a core principle London

2.Please confirm whether all parents/carers issued with a new or amended
statement since January 2012 have been informed about their right to apply
for a Direct Payment for SEN provision under the Special Educational Needs
(Direct Payments) (Pilot Scheme) Order 2012. How has this information been
provided? Please provide a copy of any standard leaflet or letter issued
together with confirmation of the date of issue.

Response: “Personal budgets in education should relate to needs that are
significant enough to need additional and individual support above and
beyond that which is normally available and funding to meet these needs,
from the high needs block (element 3), should be considered for inclusion
in a personal budget. Funds that are delegated to schools and colleges
will not normally be in scope for inclusion in a personal budget, unless
the institution has previously agreed to this. Personal budgets must not
be used to fund a school place” Indicative Code of Practice 2013.

 

 

3.Please confirm the number of parents/carers who are receiving SEN Direct
Payments and what those Direct Payments relate to.

Response: There are no parents/carers receiving DP’s in relation to
funding SEN provision (see response to Question 2 above).

 

4.Please confirm whether any of these SEN Direct Payments could be
provided outside the Pathfinder project, e.g. payments under Part 6 of a
statement for transport.

Response: DP’s for social care support may be used – see link below for an
example.

Response: At this time London Borough of Bromley are testing with those
families and Young People going through the EHC Plan process (68
currently) the implications of PB/DP across the 3 care domains (Education,
Health & Care). This work is informing, in conjunction with parent/carer
involvement, the development of policies, processes etc.

As part of this testing we are reviewing all of our contracted activity,
including jointly health commissioned services, in order to open them up
for PB/DP as appropriate.

 

6.Please confirm your arrangements for reviewing appeals against a refusal
of a request for SEN Direct Payments. Please provide a copy of any policy
and any leaflet/letter issued to parents explaining this.

Response: See response to 5 above. But refusal for a DP would be based on
the activity breaching Government legislation & guidance on the use of
DP’s.

 

7.Please confirm what information is provided to parents/carers about the
trialling of personal budgets. Please provide a copy of any leaflet or
letter issued.

Response: Parents were invited to test the principles of making their own
arrangements for any aspect of their support needs which they felt might
be better achieved by way of direct payments. 20 parents elected to test.

 

Their report concluded that:- Parents are aware of the challenges and
barriers to finding and purchasing their own services.  Professional
assessment, advice and support were highly valued.  Parents stated they
would not want to lose this level of support.  60% of parents did not
complete their test, some of whom stated that the challenges of caring and
family demands ‘got in the way’ and they were unable/unwilling to find
time to finish’. 

 

Further consultations are ongoing with parents are needed to discuss how
best to implement the changes they want and what role they see Personal
Budgets playing in successfully achieving these.

 

 

8.Please confirm how many parents/carers are receiving a personal budget
within the auspices of the Pathfinder project?

Response: At this time we are testing with those families and Young
People going through the EHC Plan process (68 currently) the implications
of PB/DP across the 3 care domains (Education, Health & Care).
