Dinas Powys Flood December 2020

The request is currently very wide and this may be problematic in responding to, as it may take longer than the allowed time for response under the legislation. Would you like to refine the question? Is there a particular aspect that you would wish the Council to concentrate on? If so please can you rephrase your question to focus on that point?

Dear FOI Unit,

Thank you for your prompt attention and reply.

Our issue is that we do not know what has gone on between the various agencies concerned with the flood, but we are very concerned at the lack of information and progress updates despite attempts to find out.
We feel we have no option now but to request all the information relevant to this incident.

I am really sorry it is not possible to break this down further or narrow the scope and I really do feel for the council as this is diverting resources ,but we simply have no where else to turn. The problem is we just don't know enough about how this all works, who is involved and what decisions have been made or what decisions need to be made but are being sat on. Its 18 months since the devastation we all felt the day before Christmas Eve but nothing, simply nothing, has happened as far as we are concerned apart from talk and sympathy. For instance, Some people came out several months ago to do an inspection of all the houses with the promise we'd have a report within weeks, but nothing.

It is simply torture sitting in your home and hearing a forecast of heavy rain; until someone has gone through that and continues to go through that week after week, they will never understand the deep psychological harm it is doing to people.
I really am sorry to do this as I do know how much work is involved having been through it myself, but we need more information so that we can ask the right questions of the right people. Inevitably, this will lead to further FOIs of other agencies involved so I do anticipate a long journey on this.

The Engineering Operational Manager has requested me to forward the information below to you to check if this can be of any assistance before we attempt to quantify your request. This is because we believe that to provide the information that you have requested is going to involve a considerable cost.

It is advised that you get in touch with the Dinas Powys Flood Action Group (FAG).

The Council, NRW and Welsh Water have been working closely with this group since the flooding incident in December 2020 and they will hopefully be able to update on actions taken and reassure of progress be made.

Also, a copy of the S19 Flood Investigation Report for Dinas Powys and a Facebook page for residents affected by the flooding as well as the councils Flooding website all contain useful information which is readily available via links below and is free to start.

The Council did not receive a reply from you and consequent to that wrote to you again 21st July 2022 in light of the non-response and asked you as follows:-

With regards to the email sent to you on the 15th of July 2022 can you please advise if this has been of any assistance.

Can you confirm that you would still like the information that you originally requested.

The Council has not heard further from you and has therefore in the absence of a response considered your request on its original basis. The Council considers that your request is too wide. Your request has been considered under the Environmental Information Regulations. The Council is entitled to refuse a single extremely burdensome request under regulation 12(4)(b) of the Environmental Information Regulations, where it considers it as "manifestly unreasonable", where the cost of compliance would be too great and providing it is also satisfied that the public interest test favours maintaining the exception.

In reaching this decision the Council has considered the proportionality of the burden or costs involved, the circumstances of the request, its nature and any wider value in the requested information being made publicly available. The importance of any underlying issue to which the request relates, and the extent to which responding to the request would illuminate that issue.
The Council has also considered its size and the resources available to respond to the request and how this would affect officers from conducting their other duties.

On this occasion it is felt given how wide your request is and the scope of the response required your request is one that cannot be responded to due to its size. The Council has considered carefully the public interest test and feels that in light of the effect on officer time which could be utilised for other business and the currently available information in the public domain on this subject matter, the exception should be applied.
