I note you have provided the following temperature measurements for the works in October 2018.

Unfortunately, I can't find the temperature measurements that were taken for the failed works in July 2018 on Dinant Link Road by Breheny Civil Engineering, Lands Improvement Holdings or the aforementioned parties sanctioned contractors. If I have missed the July 2018 weather report document in my previous request I apologise, as there were a large quantity of documents this may have happened.

On 14^th March 2019 Hertfordshire County Council received the following
request for information from you:

Your request for information has been considered under the Environmental
Information Regulations2004. I can confirm that Hertfordshire County
Council does hold the information you have requested and I have attached
it. Please note that we have redacted some contents of emails under the
following exception:

 

Regulation 13 (1) - Personal Data

 

This exception applies because you have requested information that relates
to a third party.

 

This section of the Regulations applies to any requested information which
is personal data, in that it relates to an identifiable person. The
Regulations prevent the County Council from disclosing personal data to
the public if doing so “would contravene any of the data protection
principles”. One such data protection principle (set out in Article 5(1)
of the GDPR), requires that personal data shall be processed “fairly”. In
order to process personal data fairly, the County Council must only handle
it in ways that people would reasonably expect; and not use it in ways
that have unjustified adverse effects on them. In relation to your
request, individuals who collate this information have no expectation we
would provide the public with copies of personal identifying information.

 

As part of our consideration we have noted the following Public Interest

of the Council and its officers

 

The public interest arguments for withholding the information are as

o That the public interest in withholding the information outweighs the

individual’s privacy

 

On balance we feel the public interest is better served by withholding
this information. As it would not be appropriate, fair or lawful
processing of their personal data and we are consequently satisfied the
exemption also applies to the information you have requested.

Dear Information Governance,

Thank you for the information provided. The redaction are acceptable.

What is surprising in this information provided is that the works were carried out in one of the hottest periods in July. As you can see in the readings the ground temp as 35C at 9:00pm yet the works went on regardless of this hot temperature, which does not seem sensible. The works then failed and Breheny told Hertfordshire County Council the road was decimated due to the hot weather and heavy trafficking.

Residents nearby had to suffer as they were trying to cool their properties by opening windows, this in turn allowed more noise to enter their properties. This does not seem entirely fair and hopefully the situation will not occur again.
