Digitised version of Definitive Map & Definitive Statements

Dear Isle of Wight Council,

Under the Environmental Information Regulations, I would like to request a copy of:

1 The digitised version / working copy of your Definitive Map of Public Rights of Way. My preferred format for this GIS data would be one of KML, GeoJSON, MapInfo or Shapefile. (I realise that this data is not the actual Definitive Map, but just an unofficial representation of it, which may contain errors. But that is fine for my purposes.)

2 A copy of your Definitive Statements of Public Rights of Way, assuming these are held in digital form (either scanned copies or native digital versions). I would prefer the information in a re-usable (computer readable) format. If the Statement information is already contained in the GIS data then that will satisfy this part of the request, and there is no need to provide anything separately.

Secondly, under the Re-Use of Public Sector Information Regulations, I would like to request permission to re-use the information supplied above under the Open Government Licence v3. The purposes for which the information is to be re-used are: (a) to help improve the mapping of Rights of Way in OpenStreetMap, and (b) to convert the datasets to a more convenient format, and then make them available for others to re-use under an open licence.

Lastly, in line with your general duty to make environmental datasets available online under EIR 4(1)(a), and with your duty under FOIA 19(2A)(a)(ii) to publish updated versions of requested datasets, could I ask that you provide access to regularly updated versions of these two datasets on your website. This would save myself and anyone else who wanted to make use of them from having to submit recurring EIR/RoPSIR requests every time we needed an update.

many thanks for your prompt reply to my request, I am most grateful.

I am sorry to trouble you futher on this matter, but:

1) In your response you say "I can confirm that the information is supplied to you under open data licence.", but it is not clear to which open data data licence your refer. Could you confirm whether this is the Open Government Licence v3 and, if not, then which open data licence the data is released under.

2) I recognise, as you state in your reply, that the data you supplied does not "constitute the Definitive Map and Statement", which is why in my original request I also asked for "A copy of your Definitive Statements of Public Rights of Way, assuming these are held in digital form", but there was no mention of this in your reply.

Dear Mr Groom

Thank you for your email. I can answer your questions as follows:

1) The Council's ICT department have answered as follows: We applied to OS for Derived Data exemption on the ROW data which we did and it has been agreed by OS, so we can make our Derived Data available under the Open Government Licence (OGL) terms.

2) Unfortunately, we do not hold the Definitive Statements in a straightforward and up to date manner. We hold a set of survey record cards relating to the paths recorded on the first Definitive Map in 1952 deemed to represent Definitive Statements by way of case law. Since that time there have been hundreds of changes to the network and the statement for each of those changes will be included in the legal event documents effecting such changes. I will happily provide you with a copy of the survey cards and all legal event documents which we hold but the Council would not be able to guarantee that this was a full set representing the Definitive Statement. If you would like me to do this I will save the documents to a DVD and send it to you in the post.
