20/769: FREEDOM OF INFORMATION REQUEST

 

Thank you for your email dated 09/03/2021 requesting information under the
Freedom of Information Act 2000. In that request, you asked us for
information relating to digital and retail technologies.  

 

I require further information in order to identify and locate the
information that you have asked for. I will not be able to take this
matter further until you can clarify exactly what information you require.
In particular, with regards EPOS systems, would this relate to chip and
pin devices used for card payments or only equipment such as tills?
Please note that if no response is received within two months the request
will be considered closed.

 

If you have any queries about this letter or are unhappy about the service
you have received in relation to your request and wish to make a complaint
or request a review, please do not hesitate to contact me in writing. A
request for an internal review should be made within 40 working days of
the date of the response.

 

If you are not content with the outcome of your complaint, you may apply

EPOS Section questions - Refers to any contracts in place for any physical trading environment, be it chip and pin, till system, cashless payment kiosks etc. so the answer would be all technologies using direct and non digital transactions for point of sale services.

FREEDOM OF INFORMATION REQUEST

 

Thank you for your email dated 09/03/2021 requesting information under the
Freedom of Information Act 2000. I am now in a position to respond to your
questions as follows:

 

I would be most grateful if you would provide me, under the Freedom of
Information Act, details in respect to the below questions.

1. Digital Transformation Strategy - Please provide an online or PDF copy.

I can confirm the Council does hold a draft digital strategy, this is
being withheld at this moment in time under S22 of the Freedom of
Information Act 2000 – information intended for future publication.  The
Information Commissioner’s Office guidance advises;

 

(1) Information is exempt information if— 

 

(a) the information is held by the public authority with a view to its
publication, by the authority or any other person, at some future date
(whether determined or not), 

 

(b) the information was already held with a view to such publication at
the time when the request for information was made, and 

 

(c) it is reasonable in all the circumstances that the information should
be withheld from disclosure until the date referred to in paragraph (a).

 

Section 22 is a qualified exemption. This means that, even if the
requested information falls within it, the public authority must go on to
consider whether the public interest in maintaining the exemption is
greater than the public interest in disclosing the information.

 

The Authority considers that the exemption contained within section 22 of
the FOIA is engaged subject to the public interest test, which means that
the Local Authority has to undertake a balancing exercise and consider the
factors for and against disclosure.

 

The factors in favour of disclosure would be transparency, accountability
that the Council is acting appropriately.

 

The factors against disclosure are that the information will be published
in the future.  The strategy will go to the Council’s Cabinet for
approval, it would not be appropriate to release the report into the
public domain prior to this as it is important for the Council to follow
the democratic process.   The Council publishes all Cabinet reports on its
website, the reports can all be accessed via the following link;

In view of the above, disclosure would not currently be justified by a
wider public interest.
