• What are the contractual performance KPI's for this contract?
• Suppliers who applied for inclusion on each framework/contract and were successful & not successful at the PQQ & ITT stages
• Actual spend on this contract/framework (and any sub lots), from the start of the contract to the current date
• Start date & duration of framework/contract?
• Could you please provide a copy of the service/product specification given to all bidders for when this contract was last advertised?
• Is there an extension clause in the framework(s)/contract(s) and, if so, the duration of the extension?
• Has a decision been made yet on whether the framework(s)/contract(s) are being either extended or renewed?
• Who is the senior officer (outside of procurement) responsible for this contract?

University’s Response

 

Further to Section 1 of the Freedom of Information Act 2000 (the “Act”) we
confirm that the information requested is held by the University of
Bristol (the “University”). However, we consider your request exempt by
virtue of Section 14 of the Act.

 

Section 14(1) provides: Section 1(1) does not oblige a public authority to
comply with a request for information if the request is vexatious. 

  

From the questions asked it appears that you are making a request for
commercial purposes by requesting information in order to sell goods or
services. Without clear public interest the University considers
commercial requests vexatious in line with the Upper Tribunal
ruling recently upheld by the Court of Appeal. 

 

The Tribunal case indicates that the key question when deciding whether a
request is vexatious is whether the request is likely to cause distress,
disruption or irritation, without any proper or justified cause. Although
we understand that you believe there to be serious purpose and value
behind your request, we must consider whether the impact on the University
is justified. 

  

The Tribunal concluded that ‘vexatious’ could be defined as
the “…manifestly unjustified, inappropriate or improper use of a formal
procedure.’”  A request which has no public interest can be classed as
improper use of the Act and is a valid consideration to make when
considering if a request is vexatious. Using FOI to gain a commercial
advantage or opportunity over another can be included within this
definition. 

 

Given the current working environment which has resulted in reduced staff
and additional pressures, commercial requests which have little to no
wider public interest and are only of interest to the requester puts
burden on the University and causes undue distress to staff. The
information requested is therefore withheld from disclosure
under Section 14 of the Act.

tenders run by the University are advertised to a large community of
suppliers. Alternatively, please contact our procurement department.

 

Internal Review Procedure

 

If you are dissatisfied with the handling of your request, then you have a
right under Section 50 of the Act to request an internal review.  All such
requests must be sent to us within 40 days, and must clearly state our
reference number (at the top of this email) and your reason for requesting
an internal review.  We will aim to respond to your request for an
internal review within 20 working days of receipt.
