Tom Keene made this Freedom of Information request to Lambeth Borough Council

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was successful.

Dear Lambeth Borough Council,

I would like access to any digital 3D/2D models of Cressingham Gardens Estate created by Architect Roland Karthaus during the resident consultation process. Including the Estate in its current configuration and any models created for the options which residents were consulted on. I would ideally like the digital files in such a format so they can be imported into open source 3D modelling software such as Blender. Please maintain or communicate all original file-names.

Yours faithfully,
Tom Keene

Dear Mr Keene

Thank you for your request IR132216 for an internal review received on 11
January 2016. I am sorry that you are dissatisfied with our attempts to
handle your request under the under the Environmental Information
Regulations 2004.

Your complaint is that you have not received a response.  Your complaint
is partly upheld for the following reasons.

Your original request was received on 27 October 2015, which you followed
up with a reminder email on 25 November 2015 that the response was
overdue.  You have received no reply for which I apologise.  I have
reminded the caseworker to respond to correspondence more promptly in
future and keep the requestor informed of any delays.  Therefore I upheld
the first part of your complaint.

Turning to the information that you have requested, this can be summarised
as follows.  You would like access to any digital 3D/2D models of
Cressingham Gardens Estate created by Architect Roland Karthaus during the
resident consultation process. Including the Estate in its current
configuration and any models created for the options which residents were
consulted on.  You would ideally like the digital files in such a format
so they can be imported into open source 3D modelling software such as
Blender. You also asked the Council to maintain or communicate all
original file-names.

I have checked with the Service Area and they advise that no digital files
of models are held by the Council, nor does the contract the Council has
with the Architect require models to be made available in an electronic
form to the Council.

However they are happy to release information and models which are
available, which were released as part of the consultation for the scheme.

I have attached copies of the consultation documents that contain 3D/ 2D
models.

·         Cressingham Gardens Report (March 2015)

·         Cressingham Gardens Estate, Draft Masterplan Objectives for
discussion  (September 2015)

·         Cressingham Gardens Initial Design Analysis (September 2015)

Once again I apologise for the delay in releasing this information to you.

If you remain dissatisfied with the outcome of the review you have a
further right to appeal to the Information Commissioner, who regulates the
implementation of the Freedom of Information Act. The Commissioner can be
contacted at the following address:

Dear Carter, Richard,

As the council do not hold these files, would the council be able to confirm that any digital 3D models of Cressingham Gardens are the property of the Architect who would be free to do with them as they wish? If so could this be communicated to the Architect so that I can make a direct request to them?

Yours sincerely,
Tom Keene

Dear Lambeth Borough Council,

Dear Carter, Richard,

You did not answer my questions:

1. As the council do not hold these files, would the council be able to confirm that any digital 3D models of Cressingham Gardens are the property of the Architect who would be free to do with them as they wish?
To answer this does not require any communication with the Architect. Can I please receive a response yes or no? I have been in contact with the Architect who is happy to release the files to me, though Lambeth need to confirm if they consider these files the property of Lambeth? If yes, then I request their release. if no, then they can be released to me?

Yours sincerely,
Tom Keene
