Did the Minister know about HMRC's litigation assessment?
Dear Her Majesty’s Treasury,
I realise that this is a difficult question to answer but perhaps there is a record of briefings or other communications on this matter.
Can you confirm (yes or no) if the then Financial Secretary to the Treasury Jane Kennedy had ever been briefed, prior to the enactment of Section 58 Finance Act 2008, about the assessment HMRC had made of their chances of success in litigation under the existing law?

I am writing to request an internal review of Her Majesty’s Treasury's handling of my FOI request 'Did the Minister know about HMRC's litigation assessment?'.
Your response to this FOI appears to be at odds with an earlier FOI response (below) which stated quite categorically that HMT did not hold any information about HMRC's litigation assessment. I would be grateful if you could explain how this response is reconcilable with the previous one, and thereby clarify the position as to what information is actually held.
