DHP Reconsideration/Appeal
Dear Brighton and Hove City Council,
When a tenant asks for an appeal/Reconsideration of a DHP by a 3 person panel. What is the time frame for a decision to be made?
In so doing. Do you do an Equality impact assessment? The council has a statutory duty to consider the impact of it's decisions on age, disability etc., Etc , etc.
And a risk assessment is usually carried out. To comply with health & safety legislation.
And do you consider your homeless strategy? By not awarding a DHP. And the tenant accuring arrears. They could lose their home.
Can you point me to the part of your homeless strategy that specifically concerns disabled people. And how you deal with them becoming homeless. Because of arrears. Especially when their property has been fully adapted for their needs.

following the date of receipt. Wherever possible, a response to your FOI
request will be sent to you before the legal deadline of 20 working days.

I am writing to request an internal review of Brighton and Hove City Council's handling of my FOI request 'DHP Reconsideration/Appeal'.

I thank you for your reply to my foi.
and I thank you for the links that you provided which I have looked at and read.
However I do have concerns. the dhp policy was made in 2013 and you did an impact assessment then and it states that you will be updating that I would like to know when it is updated then and when it has been updated from 2013. I draw you to 5.9 to 5.11.
it also states that you may have contact with mental health services. Can you explain that further please.
And also that disabled people should be a priority.
You also state in your answer that a decision by 3 panel members should be decided within 7 days. can you tell me what happens when it over runs this time by a considerable length.
I would think this opens up the council to judicial review.
You also say you do have considerations to the homeless strategy. But there is no priority in how you deal with disabled people if they should become homeless.
That is most unsatisfactory. that is disability discrimination and also a human rights issues.
And that also opens the council up to legal challenges.
