Development Responsibilities
Dear South Norfolk District Council,
Concerning residential developments, with a special focus on contributions and spending, please can you help supply data for the questions below.
For Section 106 documents signed between 1st January 2006 and 31st December 2011 please can you supply the following:
a) That S106 contributions were received
b) all monies unspent/unexpended
c) all monies uncommitted
d) all corresponding planning references numbers
e) any funds that have been returned to the payee

I refer to your Freedom of Information request to which I am now in a position to respond on behalf of South Norfolk Council. My response is outlined below along with your questions for ease of reference.
With reference to the below request for information relating to Section documents signed between 1st January 2006 and 31st December 2011 . Under section 1(1)(a) of the Freedom of Information Act 2000, I am advising you that the Council does not hold the information you have requested.
If for whatever reason you wish to get back to me, please feel free to do so. In particular if you are unhappy with how your request was handled please let me know and I will explain how you can request an internal review of our decision.
There is a record of S106 monies held as at 01/04/2019 and received subsequent to this date. Prior to this date we subsequently do not hold records for monetary questions (a), (b), (c), and (e).
I have gone through our S106 files and comprised a list for question (d) of all S106 agreements signed between 1st January 2006 and 31st December 2011 together the relevant planning reference number and have attached this document.
I hope this is of assistance and is sufficient to meet your requirements, but if, for whatever reason you wish to get back to me, please feel free to do so. In particular, if you are unhappy with the information provided or how your request was handled, please let me know and I will explain how you can request an internal review of our decision.

Thank you for your response and for taking the time to prepare the list of planning references.
Please can I ask, if I needed to understand the precise situation of any one of the planning references given, for example, the exact amount of money, unspent, uncommitted and unallocated, how would I go about establishing the answer? Further, depending on the wording of the agreed and signed S106 legal document, how would the owner/developer/person find out if they were entitled to monies back, of course depending on their agreed clawback.
I appreciate your help on shedding some light on this situation.
