Development Contributions

Dear Wirral Metropolitan Borough Council,

Please can you help supply the following information in regards to all Section 106 agreements that were signed between 1st January 2006 and 31st December 2011:

• The date the agreement was signed along with the corresponding planning reference;
• list all contributions and their intended purpose;
• the dates of when all and any contributions were received by the council;
• the project name and details to which any contributions were allocated, expended or committed;
• the total amount allocated, expended or committed per contribution and the date this was done;
• the total amount that remains unspent and/or unallocated per contribution;
• please confirm whether the contribution monies, either in whole or part, were held in an interest bearing account;
• name of the party/parties that paid the contribution;
• name of the party/parties that have been repaid and when;
• all council spreadsheets that contain the requested information; and
• Finally, please include either copies of the s.106 agreements or live links to where the agreements can be found.

Dear Sandra Robinson

Thank you for your recent Freedom of information FOI enquiry.

 

Having reviewed the scope of your request, we must advise that the
information requested is not held in a reportable format and in order to
facilitate your request, a manual exercise would be required to review
each of the Councils Section 106 legal agreements signed between 1st
January 2006 and 31st December 2011.

 

Under Section 12 of the Freedom of Information Act 2000, public
authorities are not required to comply with a request for information if
it is estimated that to do so would exceed the appropriate limit,
currently set at 18.5 hours. Our records show that there are at least 37
legal agreements signed between the date range. Unfortunately we believe
that your request would exceed this limit and as such the Council relies
on section 12 (1) to refuse your request as it will take more than
18.5hours to retrieve the data that has been requested.

 

Under Section 16 foia2000 , we have a duty to assist you where possible. 
If you wish to submit any re-formed or reduced scope request we shall look
at this again for you.  Officers have advised that if you would narrow the
scope of the request to a maximum of a two year period this would fit with

You have the right under Section 17 of the Freedom of Information Act 2000
to ask for an internal review of the refusal of the information requested.

We write further to your recent enquiry.

 

The Council’s S106 Monitoring Officer has reviewed your request and
determined that despite a more refined request, the collation of
information would require a significant amount of officer time to
undertake a manual search of all records over a 5 year period and that
this would still take more than 18.5 hours to finalise.

 

We must therefore maintain our original position and refuse the request
under Section 12(1) of the Freedom of Information Act 2000.

 

You have the right under Section 17 of the Freedom of Information Act 2000
to ask for an internal review of this decision. Please direct any request
