Dear Brent Borough Council,
Please pass this on to the person who conducts Freedom of Information reviews.
I am writing to request an internal review of Brent Borough Council's handling of my FOI request 'Details of Materials Recycled, Incinerated and Landfilled from Municipal Waste Stream'.
The response to my FOI request should have been received by the 25th November. I would like an explanation of why the response wasn't received by that date and an indication as to when my request will be fulfilled.
A full history of my FOI request and all correspondence is available on the Internet at this address:

Yours faithfully,
M Lempriere
Dear Mr Lempriere
I am sorry that you have not yet revceived a response to your request
request 'Details of Materials Recycled, Incinerated and Landfilled from
Municipal Waste Stream'. See our ref above.
I have sent a reminder to the department concerned.
Quite separately we will conduct an Internal Review into the delay. This
will be conducted by an officer who is senior to the person handling the
request and if practicable, who has not been involved in the response.
The timetable for these reviews is 20 working days from a complaint,
although this can be extended to 40 working days where the issues are
complicated.

Dear Mr Lempriere
I am writing to respond to your request for Internal Review into the failure to respond to request 860073 within the time permitted. I have decided it is expedient for me to respond as my involvement in the original request was minimal.
Your request was made by email to the Council dated 28th October 2011. The period for responding to requests under EIR is as promptly as possible and no later than 20 working days, although this can be extended to 40 working days under Regulation 7, subject to prior notice of the Regulation being applied. I am not aware that such notice was given or that the circumstances meriting application of the Regulation 7 extension apply in this case. The request should therefore have been answered by no later than 25th November 2011. The response was not sent until 2nd December.
The Internal Review is therefore upheld. The Council breached Regulation 5 of the Environmental Information Regulations by not responding to your request within the permitted timescale.
Please accept our apologies.
Regards
Stephen Williams
