Please could you send me details of the licensing agreement between local authorities and the Ordnance Survey which covers the use of data owned, created, or sourced by local authorities on your mapping products. For example, the use of information derived from from definitive maps and definitive statements.

Thank you for your email dated 4 February 2009, requesting: 'details of
the licensing agreement between local authorities and the Ordnance Survey
which covers the use of data owned, created, or sourced by local
authorities on your mapping products'.

Having reviewed your request we have interpreted its meaning in two ways
and ask if you could please clarify which of the following you mean?

S Derived data owned, created, or sourced by the local authorities
from Ordnance Survey mapping products, which may be re-used by any
body/company. Or

S Derived data owned, created, or sourced by the local authorities
from Ordnance Survey mapping products, which is the re-used only by
Ordnance Survey.

This will enable us to respond more clearly to your request.

Dear Mr Gray,

I'm not sure that either option covers my request so I shall clarify my request for you. What I am looking for is the licensing agreement under which data owned, created, or sourced by local authorities is made available to you for use on your products.

For example: if a local authority was to use a GPS device to locate their public toilets, and then provided this information to you.

Please let me know if this needs further clarification.

Thank you for your clarification email dated 17 February 2009 requesting:
the licensing agreement under which data owned, created, or sourced by
local authorities is made available to you for use on your products.

We are pleased to provide you with the following information with regard
to your request.

There are means by which Local Authorities may provide information to
Ordnance Survey:

o the provision of the rights of way Definitive Map for publication
within our Explorer(R) and Landranger(R) maps. This provision was set
up as a direct result of The National Parks and Countryside Act 1949,
and later the Countryside Act 1968. Ordnance Survey agreed to show
rights of way, as depicted on the Definitive Maps prepared by the
local authorities in the first instance, on our 1:25 000 Second series
(later called Pathfinder(R) maps) and the 1:63 360 Seventh series one
inch maps. This information has been provided to Ordnance Survey
since the early 1960's to better enable public access to this
information in line with statutory requirements.
o by providing product feedback (as with all our customers, not limited
to the Local Authorities) on errors and omissions in our
mapping. Being voluntary, there is no guarantee that all Local
Authorities provide information via this service.
o providing new road information from some, but not all, local Highways
Authorities under the CODES initiative (Collection of Data from
External Sources). This information is supplied from third parties to
update the OS MasterMap(R) database, enabling Ordnance Survey to
provide a faster and more efficient update service to its data
customers, including the Local Authorities. Typically information is
supplied from the initial site survey at 1: 500 scale, followed by
detailed pre-build design data and a final as-built check. Ordnance
Survey field staff still make visits to the site to provide National
Grid control and to complete the detail to Ordnance Survey's
specification. Detailed measuring and recording of all features within
the site has been cut down or removed completely, so avoiding
duplication. If discrepancies exist they can be resolved quickly
through a further check on positional accuracy using GPS. Agreements
are made with individual Highways Authorities for the re-use of this
information, please refer to the attached document for a copy of this
agreement. These agreements entail copyright
responsibilities, ensuring Ordnance Survey has a licence to use third
party information and confirming the Highways Authorities are able to
provide Ordnance Survey with the rights to make the new data available
to its customers.

Please note that your enquiry has been processed to Freedom of Information
guidelines. To the extent that the public interest (section 17) applies,
we have determined that in all the circumstances of the case, the public
interest has been met with the full provision of all information in this
instance.
