Approximately 5 weeks ago, although this date may not be exact, resident Mazhar Dogar gave to Councillor Duncan Enright a letter with over 35 questions concerning the proposed Cowley LTNs. Also given to Councillor Enright in this letter or separately, were alternate plans for the proposed Cowley LTNs.

I would like a copy of this letter and the alternate plans.

Dear Mr Barnett,

 

Thank you for your correspondence received on 02 August 2021 in which you
asked for the following information:

 

 

Approximately 5 weeks ago, although this date may not be exact, resident

questions concerning the proposed Cowley LTNs. Also given to Councillor

Your request is being considered and you will receive the information
requested as soon as possible and in any event within the next 20 working
days in compliance with the Environmental Information Regulations
2004/Freedom of Information Act 2000, unless an exception applies. This
means that the council will respond to you by the end of 31 August 2021 at
the latest.

know.

The Council neither confirms nor denies that it holds this information.
The duty in Section 1 of the Freedom of Information Act does not apply, by
virtue of Section 40 (5)(B)(a) which states that

 

The duty to confirm or deny does not arise in relation to other
information if or to the extent that any of the following applies—

(a)giving a member of the public the confirmation or denial that would
have to be given to comply with section 1(1)(a)—

(i)would (apart from this Act) contravene any of the data protection
principles, or (ii)would do so if the exemptions in section 24(1) of the
Data Protection Act 2018 (manual unstructured data held by public
authorities) were disregarded;

 

Confirming or denying whether we hold this information would by its very
nature be a breach of personal data as the Council would be confirming or
denying that it holds a letter and/or plans which were sent to Cllr
Enright, written by Mr Dogar which would be his personal data. As a
consequence, the Council considers it appropriate neither to confirm nor
deny that it holds this information, in this instance. This response
should not be taken as an indication that the information you requested is
or is not held by the Council.
