Dear Ms Davis

Your request for information has now been considered. The information
requested is as follows;

(a) addresses and rateable values of empty Commercial properties

that are within Peterborough City Council area; and

(b) the names of the owners of those properties referred to in (a)

Please see spreadsheet attached.

However following from Information Tribunal decision in Colin England v LB
Bexley on 10/5/07, Peterborough City Council reveals only names and
addresses of empty properties that are NOT owned by natural persons. This
is on the basis that S.31(1)(a) of the Act- Law Enforcement applies even
if the purpose of collation of the information was not the prevention of
crime per se and that the public interest on balance would not be served
by release of vacant properties owned by individuals. The Tribunal also
found that s.40 -Personal information applied and that `addresses' of
individuals was included in the term `personal data' under the Data
Protection Act and should on balance not be released. For you
information the council no longer owns any domestic properties following
the large scale voluntary transfer to Cross Keys. In cases where the
commercial properties are owned by the authority this is indicated
accordingly in the appropriate column on the spreadsheet.
