Details of Contract between TMBC and Carillion

We're waiting for Dave Evans to read a recent response and update the status.

Dear Tameside Metropolitan Borough Council,

Under the Freedom of Information Act I wish to see all monitoring details in respect of the contract between TMBC and Carillion for all the services supplied by Carillion in Tameside.
I would specifically like to see:
1. Copy of the contract between the 2 parties
2. Termination clauses applicable to both parties.
3. Name of officers within TMBC who are responsible for monitoring of the agreement
4. Outline of any penalty clauses applicable to either party for failure to comply with the agreement

Thank you for your email received 16 December 2013 requesting information
under the Freedom of Information Act.  I understand your request to be as
follows:

 

Under the Freedom of Information Act I wish to see all monitoring details
in respect of the contract between TMBC and Carillion for all the services
supplied by Carillion in Tameside.

I would specifically like to see:

1. Copy of the contract between the 2 parties 2. Termination clauses
applicable to both parties.

3. Name of officers within TMBC who are responsible for monitoring of the
agreement 4. Outline of any penalty clauses applicable to either party for
failure to comply with the agreement

 

Your request is being considered as a request under the Freedom of
Information Act 2000.  In accordance with statutory requirements, it may
take up to 20 working days (approximately 4 weeks) for the Council to
consider your request and provide a formal response.  Should this 20
working day deadline need to be extended you will be notified and kept
informed. Please note that the 20 working days does not include the period
between 25 December 2013 and 1 January 2014 inclusive when the council
offices are closed for the Christmas.

The council's assertion that "20 working days does not include the period between 25 December 2013 and 1 January 2014 inclusive when the council offices are closed for the Christmas" is not in line with the statutory position laid out in the Freedom of Information Act; only public holidays anywhere in the UK can be omitted.

However this does include 2 January which is a public holiday in Scotland even though the authority is not in Scotland.

that is not what I asked.
I asked to see the details of the contract between TMBC and Carillion including all performance criteria and any penalty clauses in the contract
