information from the Criminal Injuries Compensation Authority (CICA):

representative of CICA Victims yearly from 2014 to 2019

 

2. Please ensure that the list contains the name of the representatives

 

 

Your request has been handled under the FOIA.

 

Response

 

I have considered your request for information, but I am unable to answer
it without further clarification.  Section 1(3) of the FOIA does not
oblige us to answer requests where we require further clarification to
identify and locate the information requested.

 

I am currently unclear as to the exact scope of the other information you
have requested.  Section 16 of the FOIA places a duty on us to provide
advice and assistance, so far as it would be reasonable to expect us to do
so, to individuals who have made requests for information.

 

So that I provide you with the right information, you may wish to consider
refining your questions.  For example, in your first question, are you
referring to only cases where an applicant has been represented? 

 

The above requested information can only be provided for financial years
2017/18 & 2018/19. Information from previous financial years has been
archived in line with the Criminal Injuries Compensation Authority’s
(CICA) data retention policy.

 

On receipt of this information we will continue to process your request.

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review.  Internal review requests should be
submitted within two months of the date of receipt of the response to your

I can confirm that CICA holds the information you have requested. 

 

The attached spreadsheet details the compensation paid and the name of the
applicants’ representatives for the years 2017/18 and 2018/19. Please note
this information relates only to compensation awards paid to
representatives, and is not indicative of any subsequent deductions by
representatives for their services.

 

We have only provided information where it relates to six or more
compensation payments. If a request is made for information and the total
figure amounts to five people or fewer, CICA must consider whether this
could lead to the identification of individuals and whether disclosure of
this information would be in breach of our statutory obligations under the
General Data Protection Regulation and/or the Data Protection Act 2018. 
We believe that the release of some of this information could risk
identification of the individuals concerned.  Personal data can only be
released if to do so would not contravene any of the data protection
principles set out in Article 5(1) of the General Data Protection
Regulation and Section 34(1) of the Data Protection Act 2018.

 

We believe releasing some of the requested information into the public
domain would be unlawful.  Individuals have a clear and strong expectation
that their personal data will be held in confidence and not disclosed to
the public under the FOIA.

 

This is an absolute exemption and does not require a public interest test.
