Under the Freedom of Information Act, I would kindly ask that you detail the following:

1. How many separate properties are currently receiving non domestic (business rates) mandatory rate relief as a charity?

2. And can you clarify whether these charities receive this at 80% or 100% relief for the years 2016/17, 2017/18 and 2018/19?

3. How much is the total rate relief cost at 80% for charities 2016/17, 2017/18, 2018/19? This will enable comparative assessment.

4. How much is the additional council discretionary (top up) total charity rate relief cost for mandatory charities 2016/17, 2017/18, 2018/19? This will enable comparative assessment.

5. Please provide details of which charity receives the smallest and the biggest mandatory rate relief and how much would it’s rates be if it didn’t 2018/2019?

6. Are there any dwellings receiving charity rate relief for trustees 2018/19?

7. To prevent fraudulent receipt of this rate relief and provide open transparency please list these business addresses for the year 2018/19 only together with their mandatory and any top up discretionary business rate relief cost? (Ie: the cost of their business rate relief savings by being a charity)

8. To prevent fraudulent receipt of this rate relief and provide open transparency please list these business addresses for the year 2018/19 only with how mich they pay in business rates at the reduced rate?

9. How many investigations have led to the cessation of this charity related business mandatory rate relief and top up arising from the misapplication of this rate relief, its misuse or other information?

10. How many prosecutions has the council conducted regarding this specific economic crime?

Largest – The Church of Jesus Christ of Latter Day Saints - £803,900.11

I am writing to request an internal review of Chorley Borough Council's handling of my FOI request 'Details of charities receiving Mandatory business rate relief'.

1. Thank you very much for the details provided in the list however I note the charity names are not listed. Whilst I appreciate that my request referred to business addresses I assumed that the charity title would be included therein.

Could you please include this?

2. In response to my question regarding dwellings being listed as a charity and entitled to business rate relief, you have replied “yes”. Could I ask you to review this and clarify the answer with further details including how many dwellings? Your response is a bit of a surprise given I was under the (perhaps mistaken) Impression that trustees or charity owned dwellings were not entitled to any rate relief.

I refer to your e-mail dated 24 April 2019 requesting a review of your
request under the Freedom of Information Act 2000 made on 12 March 2019 to
which we assigned the reference FOI/19/148 and to which we responded on 11
April 2019. Please accept our apologies for the delay in replying with the
outcome of the review.

 

Business Rates colleagues have amended the spreadsheet that formed part of
the response made on 11 April 2019. Please see the attached. However as
they had to go through each relief record manually a couple of anomalies
have been identified. They have filled in blue to highlight them for ease
of reference. Two of the properties were showing the wrong address. This
is because the original data were taken from a query which pulled through
a previous address for the ratepayer. The amounts of relief awarded were
however correct. The other anomaly is where Council Tax have amended the
liability and there are two ratepayers receiving relief. You should be
aware that not all figures are for the full financial year.

 

In addition, as the amount to pay (end column) contained a formula it was
quoting a credit figure not a debit figure. This has been corrected.
Please accept our apologies for any confusion caused.

 

With regards to the second part of the query, dwellings are not eligible
for business rates relief. However the Council does award mandatory
charitable relief to The Trustees of the Brothers of Charity Incorporated
as shown on the attached revised spreadsheet.
