respect of Councillor Jellyman

We have now considered your request. Please accept our apologies for the
delay in sending this response to you.

We can confirm that the information you have asked for is exempt under
Section 40(2) of the Act and cannot be provided.

Section 40(2) (personal information) allows a public authority to withhold
information if its release would contravene the principles of the Data
Protection Act. This exemption has been applied because until such a time
as complaints against any elected members are formally investigated they

“It is usual practice to accept a request for an internal review made
within 40 working days from the date a public authority has issued an
initial response to a request and this should be made clear in that
response to the applicant. Public authorities are not obliged to accept
internal reviews after this date. Internal review requests should be made
in writing to a public authority.”

If, after contacting us, you are not content with the outcome, you may ask
the Information Commissioner for a decision. Before doing this, please see
the following link for guidance from the Information Commissioner relating
to how to use your information rights responsibly and effectively, to
enable you to gain the best outcome from the process -
