I write in response to your recent Freedom of Information request relating
to (1) Prospectus Design and Artwork and (2) Website Design and Management
(a copy of the full request is attached).

 

Our responses to your questions are given below.  You will see that
information relating to costs has been withheld.  Whilst I can confirm
that we hold information about costs that is relevant to your request, we
are withholding it under Section 43.2 of the Freedom of Information Act
2000 (Commercial Interests).  This is a qualified exemption which means
that it is subject to the public interest test.

 

In this case, we considered:

 

                         i.              the public interest in ensuring
that the University is able to participate competitively and fairly in a
commercial activity such as the purchase of goods and services

                       ii.              the public interest in ensuring
that we as a public authority get value for money when purchasing goods or
services

                     iii.              the public interest in scrutinizing
how public money is spent (including issues of accountability and
transparency)

                     iv.              the public interest in ensuring that
there is competition for public sector contracts, and

                       v.              the public interest in ensuring
that commercial companies are able to compete fairly in the provision and
sale of goods and services.

 

Having taken all these issues into account and considered where the
balance of the public interest lies, we are satisfied that the public
interest in withholding information relating to costs (as specified below)
outweighs the public interest in disclosure. This is because, given the
relatively short interval from one tender process to the next, we believe
that disclosing details of the value of our current or most recent
contracts would be likely to weaken the University’s bargaining position
in the market-place when next procuring or purchasing similar services.
This would prejudice the commercial interests of the University as a
purchaser which we do not consider would be in the public interest.  We
have explained our reasons for taking this decision more fully in our
responses to individual questions.

 

In addition, there is a public interest in ensuring that there is
competition for public sector contracts and that the tendering process
allows commercial companies to compete fairly and without disadvantage. 
Although information released under the Freedom of Information Act is
released to the world at large, we believe that disclosing information
relating to previous successful tenders could nevertheless result in some
companies having an unfair advantage in any future tendering process,
which we do not believe would be in the public interest.

We have withheld information relating to cost under Section 43.2 of the
Freedom of Information Act 2000 (Commercial Interests).  We take the view
that the design and artwork for the prospectus constitutes the provision
of a service rather than a commodity and that, as costs in the interval
since the last tendering process would not be significantly different,
this information remains commercially sensitive.  We therefore consider
that it would not be in the interests of the University, the public or of
other commercial companies to disclose this information.  A full
explanation of the exemption used, and of the public interest arguments
considered, is given above.

We have withheld information relating to cost under Section 43.2 of the
Freedom of Information Act 2000 (Commercial Interests).  Although it is
two years since the website was last updated, we take the view that
updates of the website constitute the provision of a service rather than a
commodity, the cost of which we would not expect to change significantly
over a two-year period.  We would therefore expect the cost of the next
update to be fairly similar to the last and consider that it would not be
in the interests of the University, the public, or of other commercial
companies to disclose this information.  A full explanation of the
exemption used, and of the public interest arguments considered, is given
above.
