Dear University of Bedfordshire,

I would like to know more about the nature of the relationship between Bedfordshire University and Campus Living Villages.

- Please provide a description of the nature of your business relationship with Campus Living Villages (CLV).
- Please give details of any current Limited Liability Partnerships (LLPs) with CLV.
- Please provide in full (or redacted where necessary to protect business interests) all contracts between CLV and the University regarding the provision and maintenance of student accommodation.
- Please provide a response as to why the University decided to enter into any LLP with CLV.
- Did University of Bedfordshire or any other wholly or partly-owned subsidiary of University of Bedfordshire approach CLV initially in respect to potential LLPs, or were these contracts offered to tender?
- Please disclose the framework for rent increases as agreed by the University and CLV within contracts regarding the provision and maintenance of any accommodation in Bedfordshire.

Please note that publishing a full or redacted copy of any contract between the University and CLV should not be refused, given that similar requests at other educational institutions that have entered LLPs with CLV have been approved. Given the extended nature of these contracts, they should be open to fair scrutiny and therefore the public interest should be found to lie in favour of their disclosure.

Should this request exceed reasonable costs as specified by Section 12 of the 2000 FOIA, then please release only the information which you believe can be can be provided within the limit of costs.

This information is withheld under Section 43(2) (Commercial interests) of
the Freedom of Information Act. This is because commission was negotiated
as part of the contract and disclosing this information would be likely to
prejudice the University’s commercial interests when this contract next
goes to tender.

The Section 43 exemptions are qualified exemptions, subject to the public
interest test.

There is a public interest in how the University spends public money.
Balanced against this is the commercial detriment caused by disclosing
pricing information that would prejudice or harm the commercial interests
of the University in subsequent negotiations with third parties, for
example when this contract next goes out to tender. It is in the public
interest that the University achieves competitive quotes from third
parties to ensure we spend public funds wisely.

The result of the public interest test is to withhold this information.

I am writing to request an internal review of University of Bedfordshire's handling of my FOI request 'Description of Relationship with Campus Living Villages'.

I believe it is in the public interest to learn of the nature of your business relationship with CLV. Many of my questions could have been answered without prejudice to commercial interests and I am therefore requesting that you conduct an internal review and respond appropriately. I understand that a full release of the contract would be against commercial interests, however it is in the public interest to demand a description of your business relationship with CLV.
