Dear Derby City Council,

I would like to request information on the number of complaints received (and abatement notices issued, if applicable) by the council within these time periods:
1st April 2016 to 31st March 2017
1st April 2017 to 31st March 2018
1st April 2018 to 31st March 2019

for the following three points:
- Noise complaints (if possible to be further broken down by totals each reason, such as dogs barking, loud music, or equivalent).
- Boundary disputes
- Accumulation of rubbish/waste

I’d kindly request to receive the data in excel or .csv format.

Yours faithfully,

Russ Hunter

Dear FOI team,

Could I please receive an update on this Freedom of Information request? The approximate deadline passed several days ago.

I appreciate that it may be ongoing but just want to ensure no clarifications or check whether further input from myself is needed.

Thank you for your time.

Yours sincerely,

Russ Hunter

FOI, Derby City Council

Dear Russ,

I have carried out another search and confirm that your original request was received 11/10/19 and has been logged.

The information you have requested relates to 'noise pollution' which is considered ‘environmental information’ and will be dealt with under the Environmental Information Regulations 2004 (EIRs).

The 20 working day deadline to send you the response was by 8/11/19.

Unfortunately, it is taking the Council longer than usual to deal with your request due to the workload of the department responsible for providing the information.

We will send you a response by 29 November or earlier, if possible. I apologise for the delay and any inconvenience caused.

If your request does not include all the information we need or is not clear, we will contact you for more information (clarification). In these circumstances, the 20 working response deadline will start the next working day after we receive your clarification response.

If the information requested is about a third party then we may need to consult them before a decision is taken on whether to disclose the information.

Under EIR Regulation 7 we can extend the response deadline to 40 working days to consider ‘complicated and volumous’ requests. We will tell you if this is the case, including your right to appeal.

There may be a fee payable for supplying the information in the form of disbursements, for example, printing and postage. We will tell you if any fees are payable which must be paid before any information can be released. The 20 working day response deadline is suspended until any fees are paid. Fees must be paid within 3 calendar months, from the date of the fees notification is issued. Unfortunately, if the fees are not paid the request will not be progressed and closed.

If you have any queries or concerns, please contact the …

Please note, the following applies, if the response includes council
officers (or other officers) names.

If you are a company that intends to use the names and contact details of
council officers (or other officers) provided for direct marketing, you
need to be registered with the Information Commissioner to process
personal data for this purpose. You must also check that the individual
(whom you wish to contact for direct marketing purposes) is not registered
with one of the Preference Services to prevent Direct Marketing. If they
are you must adhere to this preference. You must also ensure you comply
with the Privacy Electronic and Communications Regulations (PECR). For
more information follow this Link [6]www.ico.org.uk

For the avoidance of doubt the provision of council (and other) officer
names and contact details under FOI does not give consent to receive
direct marketing via any media and expressly does not constitute a ‘soft
opt-in’ under PECR.

Yours sincerely,
