Re: Derby Midland station footbridge extension, funding and access package

Please provide copies of the following, ideally in electronic format:

1. Agreement(s) between Derby City Council, Railtrack and Midland Main Line signed on, or about, 14 January 2001, showing full contractual details and the date in which they came into force
2. Agreement(s) between Derby City Council, Network Rail and East Midlands Trains signed during, or about, April 2009 showing full contractual details and the date in which they came into force
3. Any related subsequent ammendments, supplements or schedule changes to the above agreements, encounted during fulfilment of (1) and (2) of this request.

For the avoidance of doubt, this package of agreements covers:

a. Derby City Council's provision of ~£270,000 to extend the Derby Midland station footbridge to connect with the Pride Park redevelopment, The Roundhouse renovation (Derby College), and the cycling/Sustrans network;
b. the Covenants of the landowner (Railtrack/Network Rail) to maintain access to the footbridge for pedestrian and cycle use;
c. the franchise operators' (Midland Main Line, East Midlands Trains) undertaking to enable free passage by the public across the footbridge;
d. the adjustment of the original covenants to allow for the possibility of ticket barrier introduction ("gating") of the footbridge, and on the basis on which this variation was made;
e. the specification of an optional frequent-user pass system for the footbridge, should gating be introduced;
f. the circumstances under which Derby County Council may monitor and audit the pass system, and/or may order the removal of the gates should the landowner or franchisee be found in non-compliance.
