18/02/2016 – Family hearing

So for clarification are you saying, that DDJ Winslett in 2015-2016 has not been booked for any boxwork dates nor sat at the county court in Maidstone to deal with any insolvency matters or bankruptcy hearings whatsoever and none in connection with Maidstone Borough Council for the non payment of council tax.

And that on no occasion has DDJ Winslett been presented with any bankruptcy petition neither has he granted an order for substituted service of a bankruptcy petition or granted an order for an adjournment date for a bankruptcy hearing.

Dear South East KILO,

On 8 April HMCTS confirmed that DDJ Winslett's civil hearings on 07/08/15 and 19/02/16 were not in connection to insolvency.

Can you confirm what these two civil hearing dates you listed were in connection to and answer my last email dated 27 May confirming whether or not he did make any orders on 15 February 2016.

Please also clarify if any misinformation has a been given out and by whom because you have already confirmed HMCTS has given out false information about DDJ Cagney.

Yours sincerely,

Mr. Powell

Dear Her Majesty’s Courts and the Tribunals Service,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Her Majesty’s Courts and the Tribunals Service's handling of my FOI request 'Deputy District Judge Frank Winslett'.

Evidence suggests , HMCTS has been less than honest in the information they have been providing and appear to be playing for time.

Dear South East KILO,

Thank you for confirming that DDJ Eyley did not sit and hear any cases or make any orders on 15 February 2016 was this because No judges were actually sitting that day ?

I am not asking for information contained in a court record, just what type of matter he did hear.

HMCTS has had no problem confirming that none of the dates were in connection with insolvency matters, so what is the problem in specifying the type of matters he did hear.

Yours sincerely,

Mr. Powell

Dear Data Access & Compliance Unit,

I find it absolutely shocking that the MOJ can misconstrue the FOI Act to suit its own ends and to hide information from the public. I think you will find that it is the MOJ who has chosen to co-join FOI requests so that you can use it as an excuse not to answer valid questions under the FOI Act.

It is my assessment that the MOJ are a using the FOI Act as a vehicle to avoid answering valid FOI requests and to prevent information being made public to protect their own interests rather than for the public interest.

Please provide clarification as to what you are implying from your comment and list what other ways you are referring to. I have not stated any opinions and have only referenced facts.

"It is our assessment that you are using the FOIA as a vehicle to address a meter and confirm a position to support your opinion on an issue in order to take forward in other ways "

Yours sincerely,

Mr. Powell
