Deputy Chief Executive and Monitoring Officer
Dear East Devon District Council,
I see from the recent EDDC council minutes that Ms D Lyon the deputy chief executive and monitoring officer has left the employment of EDDC.
Please let me know;-
Whether she left of her own accord or was made redundant.
If the former.whether any payments were made to her ,other than the statutory "notice period" payment and what this payments was.
If the latter, why her redundancy was necessary and what payments were made to her for this reason.
Whether her position will be replaced by a new member of staff.
If not who will assume responsibility for her duties and how these will be accomplished by an existing member of staff.
What management reorganisation will take place if she is not replaces.

Denise Lyon – Deputy Chief Executive and Monitoring Officer The Chairman advised that Denise Lyon was leaving the Council and that this would be her last Council meeting. He invited Members to a small reception for Denise in the Members’ Area at the close of the meeting and hoped that all Members would join him
Her reasons for leaving, and monies paid to her, constitutes her personal data and, as such, is exempt information under s40 of the Freedom of Information Act 2000.
At the moment, the Monitoring Officer duties are being carried out by our Interim Monitoring Officer, Mr Ian Clarke.
For information, I have attached the Senior Management organisation chart.

Oh - and it took 29 working days for them to provide an answer which refers to publicly available minutes of a full council meeting.
The answer does not state whether the organisation chart provided is a long-term or an interim one, and it appears to me that this information has been deliberately omitted in order not to answer the question about the Deputy CEO role as asked.
The FoI Act says that they need to state whether the information (e.g. about whether the Deputy CEO role that Denise Lyon filled is going to continue with a replacement or not) is in EDDC's possession, and if it is in EDDC's possession to then provide it.
They have neither stated whether a decision has been made or not about the Deputy CEO role, nor said what it is.
Personally I would rate their answer as entirely non-responsive.

You made no mention as to whether the role of Deputy has been abolished or whether the role will be filled at a later time.
The role of Monitoring Officer has been described by you as "Interim"; what does this mean and when will it be filled permanently?

Interim in this context means for a temporary period. The length of time that this arrangement continues will depend on finalising the new management structure (a copy of which has been provided).

If Denise Lyon's duties were solely Monitoring Officer, then she either had very limited capabilities or was very overpaid or both.
One part of the request clearly asked whether her position (i.e. both as Deputy CEO and as Monitoring Officer) would be replaced, however EDDC has decided only to comment on her roles as Monitoring Officer.
The s40 exemption for personal data does NOT apply to this particular question, and EDDC's response appears to me to be deliberately evasive.
