Deportation orders under Section 32(3) of the UK Borders Act 2007

Response to this request is delayed. By law, Home Office should normally have responded promptly and by (details)

Dear Home Office,

The following FoI request should probably be transferred to the Immigration Enforcement Secretariat. The data could be held by the Criminal Casework Directorate, based on my understanding of who is in charge of enacting the "automatic deportation" provision.

My enquiry follows the previous request (case ref 54393) [1], in which the Immigration Enforcement Secretariat shared some data on relating to the deportation of foreign national offenders.

I would like to request:
(1) A breakdown of the deportation orders (DOs) served against FNOs between 2010-2019 depending on whether they were served under Section 32(2) (Condition 1: FNOs sentenced to a period of imprisonment of ≥12 months) or Section 32(3) (Condition 2: FNOs sentenced to a period of imprisonment for having committed a "serious crime") of the UK Borders Act 2007.

(3) A breakdown of those who were served a DO under Condition 2 in (1) depending on the crime they had committed. As Section 32(3) (Condition 2) does not require a specific length of imprisonment for the FNO to be "eligible" for automatic deportation but rather looks at the "serious crime" committed, I would expect the CCD to record information about the crime so as to justify the DO.

As I do not know how accessible and extractable the data requested is, if fulfilling the above would cause you to go beyond the designated cost limit of £600, please advise me on the ways I could narrow down my request, by informing of the level of granularity of the data that you have access to without reading each individual file.

I am aware of the data openly published on immigration statistics by the government [2], it is however unsuitable for my enquiry.

Thanks,

Y Pahe

Dear IE PQs, FOIs and Correspondence,

Thanks so much for your prompt reply.

As per your advice, I will narrow my request to the following:
(1) A breakdown by sentence length (based on the last recorded custodial sentence on your case management system) of the FNOs cited in FOI reference 54393 that were served with DOs between 2010-2019Q1.
(2) A breakdown by offence type (based on the last recorded offence on your case management system) of the FNOs cited in FOI reference 54393 that were served with DOs between 2010-2019 Q1.

Yours sincerely,

Y P
