FREEDOM OF INFORMATION REQUEST REF: 2016-1529

 

I am responding to your request under the Freedom of Information Act 2000,
which we received on 14 December 2016, for information held by the
Council. You requested:

 

Please provide me with details of the sale price of the Denyer Street
Depot.

 

At present the sale of the Council’s long leasehold interest is yet to
complete. The disposal will be registered thereafter in the normal manner
with the Land Registry.

 

It is anticipated that the transaction will complete upon vacant
possession of the site which is anticipated to be September 2017.

 

Please also provide me with the estimated cost of the proposed work on
Wiltshire Close.

 

In respect of the new facility on Wiltshire Close a scheme is being drawn
up and will shortly be submitted to planning.

 

A tender exercise will then occur for its delivery and as such it would
not be appropriate to release our budget costing prior to competitive
tendering. Release of the information at this stage would have an adverse
effect on the Council’s commercial interests.

 

Section 39 of the Freedom of Information Act provides that environmental
information shall be handled in accordance with the Environmental
Information Regulations (EIR). Your request has been handled in accordance
with EIR as it is our opinion that information requested constitutes
environmental information.

 

The exception at regulation 12(5)(e) allows the Council to refuse to
disclose information to the extent that its disclosure would adversely
affect the confidentiality of commercial or industrial information where
such confidentiality is provided by law to protect a legitimate economic
interest.

 

In accordance with guidance issued by the Information Commissioner’s
Officer we have considered whether:

 

•        the information is commercial or industrial in nature

•        the information is subject to confidentiality provided by law

•        the confidentiality provided is required to protect a legitimate
economic interest; and

•        the confidentiality would be adversely affected by disclosure

 

The exception obliges us to consider the public interest test, essentially
whether the public interest in disclosure outweighs the public interest in
maintaining the exception. Disclosure of the information would serve the
public interest in demonstrating that the Council’s commercial activities
are conducted in an open, transparent and honest way. However, release of
this information at this stage would prejudice the Council’s commercial
interests. Although we recognise the need for openness and transparency in
council affairs, a balance should be struck between confidentiality and
transparency to allow the Council to conduct business. We believe that the
public interest lies in securing the best financial deals for the council
and therefore the residents of the Royal Borough of Kensington and
Chelsea. In this instance therefore we believe that there is a greater
public interest in maintaining the exception and we are therefore
withholding the information.
