Deliberately submitting HMRC Self-Assessment Late

We're waiting for Mr McGregor to read a recent response and update the status.

Dear Child Maintenance Service,

Please could you provide details of your policies and guidance that would be applicable under the following scenario:

A NRP deliberately submits his/her HMRC self-assessment late which includes a substantial increase in income exceeding 25% so that it doesn't pull through on the CMS' HMRC-linked interface. He/she then submits two tax returns in tandem at a later date so that only the later tax return with substantially reduced income pulls through on the CMS' system.

I am writing to request an internal review of Child Maintenance Service's handling of my FOI request 'Deliberately submitting HMRC Self-Assessment Late'.

The information supplied, whilst very helpful, doesn't directly answer my question relating to cases where a tax return is deliberately submitted late and then 2 are later submitted in tandem. I'd appreciate if you could point me to the specific references in the guidance you have sent which you believe to be relevant to this specific scenario.

Thank you for your internal review response of 13th February 2020. Your review appears to confirm you are refusing to oblige by your obligations under the FOIA. Your argument that the “specific guidance or policy that would be applied would be dependent on the circumstances of the case itself” is not applicable as the example I have given you is very specific. Therefore, could you please provide the specific policies and guidance applicable to the specific scenario included in my request.
