Deleted information on audit no m4110/12/003

Under the Data Protection Act I have been informed that prior to leaving Herts CC the manager responsible for the above audit deleted all my correspondence with him including Forensic Document Scrutiny Ref No FDS 20120912 which he acknowledges as receiving from me on the 16.12.2012

Mrs Dunicliffe your FOI manager was aware that this document existed yet at our meeting when I asked her if all the information pertaining to this audit was on file she informed me it was ??????

She also refused to allow me to have a journalist with me while viewing this file

In light if the above I am now once again requesting that I see all the information that Herts CC hold on the above file

Please let me also have the procedures in place for filing information on an audit

Please let me have all the information that you have on how you recover deleted information from computers

Do you have any record of other audits where information is deleted and not held on file

Have Herts CC got Forensic Document Scrutiny FDS 20120912 ???????

Dear Information Governance,
I have clearly asked for certain information under FOI legislation and what you have indicated above is that not all the information I require will be under FOI legislation

I was quite clear in my requirements The reason why I am asking for this under FOI legislation is that it is a criminal offence to give out intentionally wrong information under this legislation and as others are following this it also allows for transparency

Another reason for asking for this is that last year I informed Hertfordshire CC as a" whistleblower "that this audit was deceitful and fraudulent I reported this along with reference to Forensic Document Scrutiny Ref ;20120912 which informed me that this audit was incorrect

Your CEO Head of Legal and the audit manager carried out an investigation in which they "implied" that they found this audit was none of my business even though it was sent to my home and the residents of Hertsmere of which I am one were charged £4335.00 for a fraudulent document that the auditors wasted 70 hrs of taxpayers money on So much for "whistlebowing "to Herts CC

All I require is have you got any information that would identify that the above officers have seen this Forensic Document Scrutiny Ref 20120912 or did the manager in the audit section delete this information prior to me "whistleblowing "

This report cost me £175.00 and now I am informed that Herts CC manager in the audit section Deleted /Shredded/ Destroyed /however you look at it you have not got this report
So where is it ?????
I will probably get a reply stating that you no longer have this file and that it is now the property of Hertsmere but you had this file for over a year So where is my report and why was this council not transparent enough in my initial enquiry last Year not to let me know the manager of the audit section had deleted my entire correspondence with him

Who is Judith Gower? and for what reason has she decided that certain parts of my question will not be answered under FOI legislation ?

I sent this report to Gush Bains Hertfordshire County Council on the 16.11.2012 and he acknowledges receiving this report on the same day .I would now like this report returned to me Only by asking under data protection act did you eventually inform me that he had destroyed the report and all my correspondence with him

I really hope that you have not sent this report or any information that I sent to him in a private capacity to Hertsmere Borough Council ????

proof of this and that Hertfordshire had charged Hertsmere BC £4335.00   I
never received a reply from Herts CC please let me have any information
you have  that would indicate that the information contained in the above
audit is correct and that the information contained in the above Forensic
Doc Scrutiny was incorrect Only one is correct
If as result of your manager in the audit section deleting my report and
all my correspondence  you have not seen this document please let me have
any information you hold that enabled you to carry out an investigation
without this evidence

I write further to my email of 15 September 2014. To clarify I am a
solicitor employed by the County Council.

 

I understand that Forensic Document Scrutiny Ref No FDS 20120912 refers to
the document that you commissioned regarding the assessment of
handwriting. It was not an independent report but a report that was
commissioned by you and belongs to you.

 

As you say Mrs Dunnicliffe was aware that the document existed. It would
appear that the document was never placed on the audit file as it was not
considered to be part of the audit or the audit process.

 

Hertfordshire County Council no longer holds the file as it has been
returned to Hertsmere Borough Council. You have either seen or received
copies of all the information that the County Council held. Other
documents such as Forensic Document Scrutiny Ref No FDS 20120912 were your
document and are therefore accessible to you by other means.

 

Hertfordshire County Council does not hold the document that you are
referring to.

Please may I have it back it was sent to Gush Bains to help him with the audit and if he has decided that it was surplus to requirements but would instead depend on three staff from Hertsmere Borough Council ,who had previously informed me under an FOI request that they did not know who had filled in the register then so be it

Please let me have any information that you hold on this audit you have information on computer even if the file is with Hertsmere

Madam your are saying that a document that disputes the information sent to me on this audit should not be part of the audit file and which was received 14 days prior to the audits publication

What does this e-mail say about the report and why would the manager place an e-mail on the file and not the attachment ?????
Only on Monday of this week your manager in the data section informed me that this report was deleted by your audit manager

I repeat £4335.00 was invoiced by HertsCC and payed for by Hertsmere BC and yet both councils knew the information contained in this audit was intended to deceive .This is not only fraud but criminal behaviour by the staff concerned

Madam both CEOs have prevented me from asking questions at full council on this audit

You inform me that this is not an independent report If going into the internet finding a specialist in hand writing analysis and paying him the sum of £175.00 for hes work If this is not an independent report then you are correct

Only yesterday Your Head of Information introduced herself to me on the phone and informed me that she had seen the document but refused to say that she had read it She kept informing me that she had seen it about three times but would not say that she had read it

You have informed me to go through the ombudsman Why

All it requires is for the port-folio holder responsible for audits to inform me at the council meeting that he can give me assurance that the information contained in Audit No m 4110/12/003

After all the three auditors involved in this corrupt audit spent over 70 hrs "creating "this work of fiction and Herts CC charged Hertsmere BC £4335.00 for an audit that both know was deceitful

Now you say I can go to the ombudsman I have done that and he has informed me that he does not deal with Fraud and Corruption .

Madam you who refuses to say whether you have read the document that informs us all that this audit is just a work of fiction Read my Independent report and then read the audit and you tell me that my Independent report is incorrect and I will personally pay £5000.00 to any charity of your choice

Why was this report not on the Audit File ?
Why did your auditor delete all my correspondence with him from this file prior to leaving ?

Maybe we can agree on one thing I say that an Independent Report FDS Ref no ;20120912 Disagrees with the information contained in Audit Report Ref M 4110/12/003

That we must agree on

My Independent report cost £175.00

The audit cost £4335.00

We can agree on that

Al the above are facts for anyone to see should they take the time to read both

Only one is correct Another fact

Your audit section took over 70 Hrs compiling this audit another fact

They have informed me via e-mail etc that this audit was going through vigorous testing before been sent to my home Another fact

[You of course have not seen the e -mails as they were deleted by your auditor before he left Herts CC ]Another fact

The final published audit informs me and here I quote that the assurance level on this audit is substantial Another fact

Surely I am not been confrontational or abusive to staff in any way When I just ask you" Can someone either your CEO Head of Legal Head of Audit any two of the auditors involved in this audit Please let me know which is correct Your Audit Report that carries substantial assurance or my Independent report after all my independent report cost £175.00 and your audit cost the taxpayers £4335.00 or better still allow the port-folio holder our elected representative to inform me at full council

Why are we wasting all this time and money when all it requires is a simple answer to a simple question

No what will happen is that I will have to contact all the councillors and leaflet the areas and make allegations against employees and all you are doing is bringing this councils good name in to disrepute

Madam I had better stop as Herts CC have a bad habit of declaring FOI vexatatious and I for one do not require you to do this again as I can guarantee you I am not vexatious but do require to get the truth I think any person who is a taxpayer and pays their council tax is entitled too this particularly where my property is concerned People work hard for to buy a property and why should anyone come into their home commit a fraud and remove some inalienable property rights from them by fraud

Thanks for this.  The reply is to go to a member of the public who I do
not think will understand anything very technical.  Elaine and I have
tried to come up with simpified reply but could you check that it is
accurate and also answer the point in red? 

 

'Data is not held on individul staff members computers, it is held within
a set of shared drives for the organisation as a whole. We take back-up
copies for the purpose of being able to re-instate systems in the event of
a technical failure and not for archival purposes. We do not retain an
older back-up copy once a new one has been made.  Back-ups are taken
every????'

We don’t hold data on user desktops or laptops, our data is managed on our
shared drives.  Our recovery process uses Comvault a data and information
management software. is tied into our SAN technology that provides Disk to
Disk and then Disk to Tape.

 

 

Are you able to assist in answering this request? If not can, please let
us know as soon as possible. We also ask that you clearly indicate which
questions you may not be able to assist with.

 

Where you are unable to help with the response, are you able to suggest
who would be better placed to answer it?

 

If you are able to answer it we will need information BEFORE 3pm on the  
10th October  2014 as this is the statutory deadline.

 

If you have any concerns about releasing the information or any queries

Dear Information Governance,
I believe that I am getting internal messages that are not meant for me to see What I require from you is I sent your auditor information that proves that the audit that was sent to my home by your manager in the audit team was an intentionally corrupt audit that HertsCC charged Hertsmere £4335.00 for this fictional work and Hertsmere paid Herts CC for this corrupt audit knowing it contained wrong information
I sent your manager in the audit section a lot of correspondence that should have been on this audit file But prior to leaving Herts
he deleted all my correspondence with him including an independent report that proved that the information contained in the audit was incorrect
Why would he delete this report and not place that and the rest of the correspondence on the file ???Can you recover the information that he deleted from hes computer That is what I require to know or is all my correspondence with him lost for ever Thats just to clarify You are quite right I would not be able to understand anything too technical on computers but unfortunately for your auditors I do understand when I see a fraudulent audit

[g] Last year I reported via your "whistleblowers "web site that audit
m44110/12/003 was a fraudulent audit that was sent to my  home by your
audit manager I referenced Forensic Document Scrutiny  ref 20120912 as
proof of this and that Hertfordshire had charged Hertsmere BC £4335.00   I
never received a reply from Herts CC please let me have any information
you have  that would indicate that the information contained in the above
audit is correct and that the information contained in the above Forensic
Doc Scrutiny was incorrect Only one is correct
If as result of your manager in the audit section deleting my report and
all my correspondence  you have not seen this document please let me have
any information you hold that enabled you to carry out an investigation
without this evidence

Data is not held on individual staff members computers, it is held within
a set of shared drives for the organisation as a whole. We take back-up
copies for the purpose of being able to re-instate systems in the event of
a technical failure and not for archival purposes.

Our recovery process uses Comvault, a data and information management
software which is tied into our Storage Area Network (SAN) technology.

We have a Whistle blowing policy. Please see Annexe 17 of the Constitution
mentioned above.  However this applies to ' all County Council employees
(with the exception of school based employees as referred to below),
agency workers working for the County Council, contractors working for or
providing services to the County Council, a person providing goods or
services to the County Council under a contract, including anyone
providing goods or services on their own or a third party’s premises. It
also applies to County Councillors.'  Any concerns reported by members of
the public would be dealt with under our Complaints Procedure.
